JD Byrider was advertising their tax special in April of 2003. I had just returned to work following the birth of my second child. I had imperfect credit and not a lot of money, so their advertisement for paying "$39 a week" sounded ideal.

I went to JD Byrider in the middle of April, 2003. I told them I was going to go back to college in the fall and needed something with a good price that would safely transport me and my children and could handle a lot of miles. They showed me one car... and that was it. It was the only car I could have.

Thinking it was either that or nothing, and they already had my trade in pretty much gone and they acted like I was all ready to go with financing, I caved in.

Within the first thirty days, the exhaust pretty much started dragging. It had to be brought in and fixed under their warranty. Now if I detailed all of the break downs, this would never end. To make a long story short, it had to be towed several times from my college in the first year, pumps and pipes went out left and right, and every time I took it to their garage to get it fixed according to the warranty, they just put a quick fix on it that would cause me to bring it in a month a two later.

I finally had a shop lift it up and look under it. They said that it had been sitting somewhere for a long time on some grass and had just completely rusted everything underneath. There were just chunks of rust everywhere. The sides had been "bondoed" together and repainted to hide the rust damage.

So this car has cost me hundreds in towing, repairs and caused me to miss countless classes.

Then there is the whole financial aspect. My mom's friend sold the same year car (it was ten years old when I bought it) make, and model to someone for $300. Wow. My payments are $275 a month. I pay for the worth of the car every month... and then some.

Oh, and God forbid I am even a day late on my payment. (Which is hard to make when there are countless repairs). They do not hesitate to call up all 20 references and harass them beyond belief. They even come to your door and bother you if you are two days late.

Recently my church offered to pay my car payments until I am done with my BSN. They apparently took too long to get the first payment to them so they came out and put a club on the steering wheel. I immediately had a lady from the church call with her credit card and they promised to come take it off. I missed school that day, not to mention my son was ill and I couldn't get him to the doctor.

It was paid at 9:30 AM and two days later, it is still there. CNAC will not return my calls, and I am about to miss another day of class. I do not know the laws regarding clubs on cars, but I really need to find out. Also, my son is even more ill, and I seriously need to take him to a doctor. My bills are paid... they need to take the club off.

I have tried talking and reasoning with these people. They tell me that my car is just "fine." They have been smart aleck with me, and have even laughed in my face. They are lying, cheating harassing thieves that need to finally get sued.

Michelle, you have options - JD Byrider and CNAC have a pattern of abusing customers like yourself in Ohio.

On February 9, 2005 the Ohio Atty. General settled a claim involving all Ohio JD Byrider locations. More than 300 consumer complaints initiated this investigation. JD Byrider agreed to make changes to its business practices. They were fined more than $600,000 as well. It doesn't appear that they learned anything from this and they are still abusing customers like you. Contact the Atty. General's office today by phone or email. Phone, 800-282-0515; email www.ag.state.oh.us. File a complaint against them. I believe they will help you. Also, contact the Better Business Bureau in your city. Save your correspondence with them and the atty. general in case you need it in the future if your loan charges off. Good Luck!
