On 11/12/2007, I went to Jim M'Lady dealership, met with Mr. Brian Murphy (Finance Manager) and informed him that I like to cancel the extended service warranty which they charged me $1285.00, he told me that I have to wait at least 10-12 weeks for the refund check because that's how long it takes for the First Extended Service Corp to issue the check to Jim M'Lady, and he will not issue the check to me, instead he will deposit the check to the financial institution Baxter Credit Union where I finance the loan.

I told him that I prefer him to issue the refund check to me instead to Baxter Credit Union. He refused. I called Mr. Jim M'Lady (owner) over the phone, he hung up my call twice and refused to give me an explanation as why it takes 10 weeks to get a refund check and why they cannot issue the check to me.

I contacted First Extended Service on 11/13/2007, and I was told that my service agreement has not been entered by Jim M'Lady yet as of 11/13/2007, in other word, Jim M'Lady still holds my extended service agreement, First Extended Service does not even know the existence of my extended service agreement.

Jim M'Lady Nissan refuses to issue a refund check within a reasonable time period (1 weeks top) and blame it on the First Extended Service Corp as excuse for not able to issue me a refund check within a reasonable time frame, while Jim M'Lady actually still holding the money, I am paying on the interest on this money at the mean time. I believe Jim M'Lady Nissan is engaging in a deceitful practice that holds on to consumer's money for a unreasonably long period of time without refunding the money to consumers. When I inform Baxter Credit Union that they have to wait for at least 10 weeks for this money, they told me that based on their experience, cancelling an extended warranty agreement, I should expect to wait at most 1 -2 weeks to get a refund check.

First and foremost, I would like to thank you for voicing your complaints with our company. I am sorry to hear that you had to go through this experience. The way warranies work, is when you have a payoff still left on your vehicle, the refund is sent to your bank. This is not through us, this is how warranty companies work.

Cancellations do sometimes take a little longer to go through. We do try to put everything through as quick as possible.
