Bob, This is my area of expertise, and I can tell you how to fix it, get your money back AND put the jerk in jail for a long time. This is as long as you had a written contract. Please tell me you had a signed written contract. 1). File a complaint against the operational authority of the carrier. This act is flat out illegal and can get your authority revoked by the FMCSA. Go to the FMCSA website and get all the info you need. At very least, your complaint will be available for all to see. 2). What they did is the definition of EXTORTION. This is a FELONY in the classification of FINANCIAL CRIMES. Major prison time here and the conviction is almost guaranteed if you have documentation. You need to file a complaint with the FBI. 3). If a broker was involved, you can file against the bond for your losses, and he/she is out of business, as another bond would be impossible to get. 4). You can file aginst the carriers cargo insurance if you had a firm deadline that was missed that cost you crane time, etc.. They won't pay, but will document your claim and put that carrier under review and may re-rate premiums and deductibles, etc.. 5). A small claims case is a slam dunk if you have a contract. Max award in small claims last I knew was $5,000.
