You have THREE accounts and you made an EIGHTY SIX CENT transaction and you made a FOUR DOLLAR deposit to cover SEVERAL INCOMING TRANSACTIONS? WOW, we're talking major finance here. And you're worried about your Labor Day BBQ? What are you gonna do? Make another TWO DOLLAR deposit to cover your Labor Day BBQ? As for criminal charges, legal proceedings and small claims court, I'd be careful.

M & T Bank committed very much fraud on my accounts, so I agree 100% with you, and the rebuttals saying "are you kidding" are fraudulent people protecting fraudulent activity.

The balance in your checkbook was not $25.34 rom what you said - the balance in reality was -$0.18. So when you made an $0.86 withdrawl, you were already in the hole and incurred the NSF. Since the NSF issuance is based on what's in your account at end of day, 3 NSF's is correct and I checked the bank's math and it is correct with your balance at -$93.04. In reality, you didn't have the money for a Labor Day BBQ anyway - just have yourself a good time and remember checkbooks don't balance themselves. The other thing I would keep in mind is that all banks essentially operate the same way and the policies that caused your overdraft are identical to just about every bank out there. Your problem isn't the bank - it's writing checks for money you do not have and what happened to you would repeat itself everywhere, in every bank, in every way. If you're planning to file small claims for this, save your money and time. What they did was legal and per the account agreement you signed. Too many ROR's on this subject. (sigh)

is that when you initiated the $.86 transaction you were already overdrawn in your account (25.34 - 17.61 - 7.91 = -.18). You need to make the deposit before spending it. And the bank is at fault because?????
