This is a copy of the letter I am sending to Macaroni Grill: (name address etc removed for security purposes)

I am writing you this letter due to an incident that occurred months ago at the Tryone Square location of Macaroni Grill in St. Petersburg Florida. My son was dining at the restaurant with friends.

After eating his meal he noticed that his retainer was gone. He asked the waiter and manager where they had put it. The waiter claims to have no memory of a retainer what so ever. It was obviously thrown out in the garbage.

The issue I have here is that the waiter actually tried to pick up the retainer which was on a plate before at an earlier time during the meal. My son clearly told him that his retainer was on the plate and not to touch it until after he had left. Instead, during desert the waiter removed the plate and threw it away. There was nothing else on the plate except the retainer which isn't too hard to miss.

I dine at Macaroni Grill quite often with my son and no incident like this has ever happened before. After speaking with the manager on various occasions he promised to call his insurance company to see if they would cover the cost for a new retainer: $180.00.

Instead, he clearly ignored us and never returned phone calls made to him. I am writing to you because it is my understanding that you are the regional manager for this chain of restaurants. I am requesting reimbursement for the 180 dollars I had to spend to purchase a new retainer because of your waiter's negligence and haste to get people out of the restaurant.

The retainer left on the plate is your responsibility and the restaurant is not liable. If you told the waiter not to bus the plate, thats fine. What you do not understand is that restaurant staff often works as a team. It is very likely that a busboy passing by took the plate (to give you a clean table for desert and an overall better dining experience) while the waiter was possibly taking an order at another table. It is unrealistic for the waiter working in a large operation to contact and explain to every employee that may be in your vacinity why they should not pre-bus one particular plate. Its fine to request that the plate not be bussed, however you should have then kept an eye on it. Also, it may have been in better taste to suggest to your child to fold up the retainer into a napkin and put it in a pocket or purse. This is coming from someone who has worked in the restaurant industry for ten years and had worn a retainer for four years.
