I purchased a yorkshire terrier puppy from Marilyn Austin, from Idyllwild, California. I bought the puppy on July 19, at three in the afternoon, the breeder brought the dog to me....red flag...she said she lived in Idyllwild, and would bring the pup to me since she had business in my area to conduct. Upon arrival the pup was very sick, wobbly gait, almost weak looking and lethargic, Marilyn asked me for some nutri-cal,a supplement used for dogs for a nutritional boost. She gave the pup six doses...another red flag.....said the pup was simply car sick, vomiting from the ride down the mountain. I trusted her.....anyone knowing about small yorkies sometimes they are known to have hypoglycemia, low blood sugar, this darling little dog is a victim of uncintrollable sugar problems, her sugar level would drop and rise dramatically, while on the same, exact vet prescribed diet....raising question of her having a congential defect....liver shunt...

The bredder was well aware of her grave condition upon selling her to me, the pup even had a bald area on her that the breeder said was caused by another puppy pulling her hair out, after familiarizing myself with the puppy, it is obvious a shave area that had a glucose i.v, the only remedy to keep her alive. I called the breeder less than 24 hours after receiving the dog, her bogus contract said that the dog could be returned within a 48 hour time frame after purchase,the contract also stated that that the new owner needs to take the dog to the vet to ensure its health guarantee, in which we did (two vets in fact) and after finding the dog to have serious, life threatening problems, called the breeder, only to be told that she would not take the dog back because we had taken the pup to the vet and that the pup had probably been exposed to parvo at the vet office...ridiculous, her contract obviously is bogus.

after attempting to contact this heartless woman, for 3 days without success, by chance she was located, by the way according to the California puppy lemon law, a breeders contract has to have the breeders address on it, hers did not...another red flag....and like I said it was just by a mere chance that we found her...if we had not we be out 2,500.00 dollars and a dead pup. A funny thing, she had filed a harrassment report against me for excessive calling...duh...a gravely sick pup, a 700.00 vet bill, and a time limit on a return, and no call back regarding the pup......what other options do I have but to call her....I had a officer present on the exchange, the agreement was we give the pup back and they return the purchase amount...which was agreed upon, nothing was mentionedabout the vet bills. I had intentions of taking her to small claims court to settle that. She told me at the exchange that I had to give her the gravely ill pup and she would give me my money, but I had to sign this hand written scribble note saying I would release them of anymore financial liablity...after arguing, I signed the note out of durress.

AFTER TALKING TO MANY PEOPLE ABOUT THIS, I HAVE FOUND OTHER PEOPLE WHO ARE AWARE OF THESE PEOPLE..... THIS WOMAN AND MAN ARE SCAMMMERS, THEY DO THIS ON A REGULAR BASIS, THEY DRIVE A SUV WITH NEVADA PLATES...ANOTHER WORD OF ADVICE , I DID ALL OF MY RESEARCH ON THIS BREEDER AFTER THE FACT....AND I DID PLENTY, BELIEVE ME, I FOUND OTHER DOG PEOPLE WHO KNOW HER AND I DID NOT GET ONE, NOT ONE POSITIVE COMMENT ABOUT HER DOG BREEDER PROFESSION, I WAS ADVISED TO NOT BUY FROM HER AND THAT THEY WERE SORRY FOR MY MISHAPS WITH HER...

OH ONE MORE TIDBIT OF IMPORTANT INFO. MARILYN AUSTIN DOES NOT SHOW HER PUPPIES AT HER HOME, MAJOR RED FLAG. SHE IS KNOWN TO MEET POTENTIAL BUYERS IN WAL-MART PARKING LOTS, AND SHE USES EXCUSES SUCH AS ON MY BROTHER LIVES IN YOUR AREA I AM ON MY WAY DOWN THE HILL TO MEET HIM FOR LUNCH, ETC. OR SHE INVITES HERSELF TO COME TO THE BUYERS HOUSE TO DELIVER THE PUPPY, SO ONE CANNOT VIEW THE PARENTS{SHE HAS NO PARENTS]. WORD OF ADVICE. ONLY PURCHASE A PUPPY FROM SOMEONE WHO INVITES YOU TO THEIR HOME OR AT LEAST GIVES YOU A ADDRESS.

Sick puppy, thank god for the california puppy lemon law, a suit is being filed to retrieve the vet bill money..... my mom is not a broker....my mom said no such thing to marilyn about selling local breeders babies...WORDS OF CAUTION, I HAVE LOCATED SEVERAL PREVIOUS BUYERS OF MARILYNS WHO HAVE BEEN FRAUDED JUST AS MYSELF, AND WE ARE ALL WORKING DILIGENTLY TO STOP THIS HORRIBLE PUPPY MILL OPERATION, WITHOUT MENTIONING NAMES SEVERAL FELLOW BREEDERS OF HERS WARNED ME OF HER SCAM....SHE ALSO IS KNOWN FOR THIS IN OTHER STATES!!!!!! SO BUYERS BEWARE...A BRIGHT NOTE...I PURCHASED A DARLING TINY YORKIE BABY WITH A RIGHTEOUS CONTRACT WHO IS HEALTHY AND BELIEVE ME THE BREEDER IS LEGIT.... END OF DISCUSSION, I AM SURE MARILYN WILL REFUT WHAT I HAVE SAID, SHE IS A WOMAN OF MANY STORIES....I AM DONE....THE LAW WILL HANDLE THE REST....

TAMERA CHASTAIN/PROSESI (COUNTNEYS mom)told me while I was at her PET/GROOMING Store in Yucaipa, Ca., that she SELLS PUPPIES for LOCAL BREEDERS in her PET/GROOMING BUSINESS. She would be a BROKER as she does not breed dogs! The defination of a BROKER is "One that acts as an agent for others, as in negotiating contracts, purchases, or sales, in return for a fee or commission". I'm the one that filed a COMPLAINT with the Riverside County Sheriff's Department for Harassment and called to have a Sheriff present for the return of the puppy! The California Puppy Lemon Law applies ONLY to breeders (dog or cat) or BUSINESSES that produce AND SELL more than 50 puppies in a year, not to hobby breeders! If you had read and comprehended the law, you would know this! As anyone that had ever produced a litter of registered pups knows, if you breed your male with some else's female, the owner of the female is the only name listed as the breeder on the pups regristration papers. If you own both parents, then your name shows as the breeder. (I'm trying to make this SIMPLE ENOUGH for Courtney to understand). PUPPY UPDATE! LITTLE 'GUCCI' is doing GREAT! She's almost her old self! I'll be showing her within the next few weeks and am telling EVERYONE about the ordeal that she's just been through! I've had alot of repeat buyers & referrals over the past 20+ years! I've made quite a few "DOG PEOPLE " friends and receive "puppy how goes it" e-mails, notes and phone calls from VERY HAPPY PUPPY BUYERS! The Moral of this story is "You Can Please Some of the People ALL of the Time, All of the People Some of the Time, But you Can't Please All of the People, All of the Time"! I've said all that I'm going to say regarding this matter! The money's been refunded and I have the puppy! End of Story!

Bottom line, I bought a puppy, vet-confirmed, that was gravely sick, not caused from change of diet, rolling over on the baby, whatever else she blames the puppies sickness on...According to the california puppy lemon law, a breeders name and address must be on a contract, not on this womans, just a name and a phone number....she did not return any messages regarding the sick pup as she alleges she did...I was forced to locate her, with the sheriffs help. I contacted the sheriff, to help with this return. I have talked to several other people who have bought pups from her, and have said thay have found that she is not even the breeder, she is a broker....and for her to say my mom is a broker is bogus, my mon sells her own pups when available....and believe me if there is a problem, my mom is accessible.....unlike marilyn austin...what is this arrest stuff? great story....

Courtney is a want to be Lawyer with no respect for the law and was nearly arrested 3 times during the return of this puppy! Her mother did purchase a puppy from me (Tamera Prosise aka Chastain). She was in perfect health when she took her from me, unlike the slanderous remarks and lies stated above! She is 3 months old and 15 ounces and requires lots of special care as tinies can easily go hypoglycemic! I stressed this to Tamera and her daughter Courtney. At 9:30 am the following morning I called for my normal morning after call and Tamera told me that the puppy was doing great i.e., investigating the house, running and playing and that they were so happy that they had found her and then mentioned that they had changed her food, a big NO NO with tiny puppies of any breed. The stress or a new home is hard enough, but changing the diet on top of that can throw any tiny breed into an hypoglycemic attack, which is what happened to this pup(and possibly being rolled on). I received a call at approximately 3:30 pm that day and was told that Courtney and the puppy had fallen asleep together at approximately noon and when Courtney awakened, (approximately 3 hours later) the puppy was in a coma (severe hypoglycemia). Severe Hypoglycemia can cause permanent damage to the Heart, Kidney & Liver! I'm not responsible for the buyer changing the puppies food, not feeding her enough and possibly injuring her! We signed an Agreement of Sale Contract that states I would replace the puppy if the veterinarian attested to a life threating condition within a 48 hour period with a written statement and that I was not responsible for medical expense. No such letter was ever written, even though the buyers told the Sheriff's and us that they had such a letter, Another Lie! I believe that Courtney rolled on the pup during her nap as her mother Tamara, said that the vet told her the pup was coughing up blood. This is not normal unless their has been some kind of trauma. I did take the puppy back with a full refund and had her sign for the cash and that "This exchange prohibits either party from further legal action related to this matter", which we both signed. I received numerous threatening calls advising me that they were going to slander me to everybody and that they would post a complaint on Rip-Off.com., if I didn't refund them their money. They money was refunded, but they still filed their Slanderous Complaint! The contract we signed called for a replacement, not a refund. They were basically Blackmailing Me! I'm the one that asked for a Sheriff to be present for the refund ,to keep the peace as I didn't want to meet these people alone as I didn't trust them. They had bombarded my home with calls at all times of the day and night, so I filed a Harassment Complaint with the Riverside County Sheriff's Department. Tamera (the buyer) has forgotten that I talked to her vet (she had to call the vet to OK her talking to me per California Privacy Laws) on the phone with the Sheriff present, and was told by her vet that there was no confirmed liver shunt as Tamara stated, since she refused to pay for the required test for financial constraints. The vet said that the symptoms could be resultant from a shunt or from diarrhea (possibly caused from the diet change), hypoglycemia or other factors. I told her about the daughter possibly rolling on the pup and told her that she had never had a sick day until these people bought her. She stated that she could only go by what the owners had told her. I've had the puppy since last Monday night and she's fine since she's back with someone that knows how to take care of a tiny puppy. I've raised Yorkies for 28 years and have a super reputation and have lots of repeat buyers and tons of referrals. We dealt with two Riverside County Sheriff Deputies; Corporal John Stenzel and James Keener, who handled the actual return of the puppy. You'll find out that this person (Courtney) has really twisted the facts. Courtney even called Both Sheriff's Liars. She also said that she was going to file complaints against them. I've blocked their (Courtney & Tamara's) phone numbers and if they continue to harass me the Riverside County District Attorney will press Criminal Charges against them per the Riverside County Sheriff's Deputies. If you raise tiny or TEACUP Yorkshire Terriers BEWARE of these two as they don't know how to care for a Tiny Yorkie. By the way, the mother, Tamara, told me that she Brokers dogs in her Yucaipa Grooming/Pet shop and is very quick to critize other local breeders and pet stores in her area! Tamara has Holly Woof Woof Dog Boutique in Yucaipa, California which is located on Yucaipa Blvd. near 10th Street. They live at 11471 Deerfield Drive, Yucaipa, California 92399.
