 I was a resident of The Lofts at Prospect Point in Villa Hills KY, a Nexus Property.  I lived there prior to Nexus buying the community when Rookwood still owned it.  I signed a 6 month lease in January 2013, but ended up moving and turning in my keys June 1, 2013.  Because of this, I paid an extra month's rent but understood that this was required since I was leaving early. 

Mid- June I got my security deposit back and believed everything was fine.  Mid-October I got a letter from the new property management stating I owed over $300 for damaged carpet.  I called the leasing office and spoke with the manager.  I explained that my security deposit had already been returned and I was confused on why they didn't check the apartment prior to returning my deposit.  She said she did check it herself and it was fine, but that in October she was having the carpet replaced and found stains on the underside of the carpet.  I asked her if the carpet was new when I moved in and she replied no it was 2 years old at that point. 

I then asked her why she felt it was my responsibility to pay for this, when in my opinion it was not my responsibility.  Furthermore, I told her that she should have done all this prior to returning my deposit.  I kept asking her why she felt it was my responsibility when I knew it was not me who ruined the carpet.  She then went on to state the dog that I had in my apartment for 2 weeks did the damage and that I was in breach of my contract because I did not sign a pet addendum.  I then informed her that when Dave was the office manager prior to her, I told him my boyfriend's dog was going to be staying with us for 2 weeks while his mother was out of town and I asked him if I needed to sign any paperwork.  He then informed me, that since the dog was not living there but was just visiting, it was not required for me to sign the pet addendum. 

 At that point the new manager said that that was a moot point since he was no longer working there.  At this point in the conversation, she kept repeating that I was responsible for this and needed to pay her.  I felt very taken advantage of and told her that I guess I had to acquire an attorney because I did not feel this was my responsibility.  Within one week a collection agency was calling me to collect the money the manager at The Lofts through Nexus Properties says I owe.  I have been dealing with the collections agency now for over a month and have had to obtain counsel because of this.  I have never had any problems with renting an apartment before, nor have I had any marks on my credit.  Now I've been told, because of this, come January, if no conclusion is reached, it will go on my credit.  I am extremely upset over this and just wanted to let others know that this company is under-handed and I would not recommend anyone renting from them.
