On October 2 2009, I recieved a call from my friend saying that she recieved a call from an Office Jack Smith of the Department of Law Investation. She than call them back after being harassed on several ocassions. They infomred her that they were looking for me and that i had a fraud case pending against me for some Cashnet Marketing Loan that i took out.



My friend than called me and told me what was going on. There is something that is call the FDCPA (Fair Debit Collection Practice Act) which at this point was violated on two different time wish is govern by the FTC(Federal Trade Commisson). I than called the company I told them who i was the man with the Pakastain accent told me that i was not me and that i was someone else.



I told the man again who i was after arguing with me about who i am. He than id his self of Office Shawn Miller who is the senoir investagator and the head attonery. He told me to grab a pen and paper to take some information down. He told me i had case against me for this loan that i took out in January of 2008 for $400.00 and the check was returned on March of 2008 for $350.00.



Now you owe $2000.00 but you can settle for $985.00. I interpurted this Officer Shawn Miller and asked for the nuber to Cashnet Marketing. He told me that they have been trying to contact me and now it to late cause they don't want to here nothing i got to say.



Officer Shawn Miller told me that i was being sued and that the police was coming to my job and home. I tryed talking to him about the so called claim and told to shut up and listen and that i was stupid. I asked him for the account nubber that is was sent to he gave me the routing # to the bank on several occasions.



He told me that i don't need the it is too later that i am goingto be sued. Again this is violation of the FDCPA after going back and forward with this man he told don't worry about anything that the polce will be at my house and hung up.



I called him back he told that he was going to have a smok that i don't need to worry the police will be here. Again a violation of the FDCPA he than told me not to worry that he is attoney and i cn;t do nothing to him laughed and hung up.

Scam Scam Scammity Scam.

Did the police ever show up? I'm guessing they did not.

Let's get down to the nitty-gritty here. I'm assuming that they are alleging that you took out a "check for cash" loan, wherein you write a personal check, the lender gives you cash, and waits a determined amount of time before cashing the check. It's basically a short term loan with a little bit of a safety net for the lender.

Now, in some jurisdictions, if the check comes back NSF, you have technically committed check fraud. However, the jurisdictions that will actually prosecute this are few and far between.

In most cases, even though there's a check involved, it's viewed as a purely civil, debtor/creditor issue. This is because, even if you date the check for the day you receive the cash, the lender knows that you don't have the funds to cover it. So he isn't really being victimized, he's just taking a risk that your check will clear in a week or so.

What you have here is are some HUGE FDCPA violations. Posing as an attorney when you are not in fact an attorney, misrepresenting the amount of a debt, threatening legal prosecution when such is not allowed per the law, and probably a few more.

If you can figure out who these people are, I would STRONGLY reccommend filing a small claims action against them, listing each of the FDCPA violations, and requesting $1000 in damages plus court costs and any other amounts as allowed by law.

You will probably find that they are hard to track down. As a first step, I would suggest contacting cashnet and finding out who they hired to collect.
