My husband and I have had Option One approximately 4 years ago. We hit hard times in May of 2005 and ended up with our home in foreclosure.

Our foreclosure contract stated that we were to pay $2,000.00 by June 20, 2005 in order to keep our home. Our payment plan for the following 12 months were $1,168.74 due on the 20th of each month and payment was to be made via Western Union.

We sent our money for the June 20th the day it was due and kept to our promise of on time payments. We made 2 payments of the $1,168.74 exact payments and 10 months we paid $1200.00. On our contract it fully states that the last month on the monthly payment plan was June 2006.

On June 6, 2006 we receive our Court paper of the Voluntary Case Dismissal which Option One had there attorney file! On June 20, 2006 my husband and I made our last payment via Western Union like always and called the control number in when we were done paying it.

The lady that took our last payment informed my husband that we were dismissed from the foreclosure and that Option One would be sending us in writing a letter along with our monthly statement stating when our payment would be due for July 2006. She fully stated that the payment would go back to the normal $828.64.

In the meantime we are trying to refinance our home with a more reputable company and thought that we would pull our credit file. To our suprise Option One has reported payments late that were paid on time and reported it as being late for July 2006 and in fact, the payment wasn't due yet for July and furthermore, we never recieved our statement and letter as promised.

In the meantime, they have an account with $500.00+ in an account from left over monies since we had been sending more money then our payment was. They have said not one word of what they plan to do with our money that is left over and certainly have not offered to send it back since it can't be used they say.

I then started calling the company on July 10, 2006 to find out the status and why we havent received the paper we were promised.

They informed us that we had not paid our June 2006 payment. I immediately pulled all of my receipts from the past 13 months and told them the control number. They then told me that the money control number I gave them identified the payment but that it was applied to the May 2006 payment since we did not pay that.

I then gave them the transaction number for May 2006 and they told me to call back. Not only can I not understand these people since they are in India.. but they are putting me on the run around and saying they are going to take care of things and arent.

After a couple days, I finally demanded to speak to a supervisor or manager. Of coarse you have to pull donkey teeth to get anyone to get on the phone because they are always supposably busy. Then after telling them I was going to the White House with my problem, they put a supervisor on the phone.

He proceeds to tell me to fax all my reciepts which I did. I also faxed my copy of my court document of Voluntary Dismissal and the copy of my contract. I have still not been contacted by anyone and on top of that, they tell me not to send any money for July 2006 until this is resolved.

In the meantime I am refinacing with another company whom had Equifax 3 way call me with Option One to verify my current payment. Well of coarse that can't be confirmed because they are reading to Equifax what the computer says which is wrong information. Needless to say that call got mysteriously disconnected.

Today is July 16, 2006 and No word yet, I wonder if they are doing this on purpose so my payment can be late or they can put me on the run around like they have done many others and then throw them back into foreclosure? This has been a total nightmare for my husband and I.

How do these people have the right to report to credit bureau's wrong information and not fix it. Now, we are sitting here with a low credit score that could be better if they would fix the error.

On top of this, I can go to Option One's website and view my account summary and see that all my payments were paid, paid on time and should now be current. But when you go to the Loan Information, it says that the account has not recieved a payment since May 2006 and that our next payment is due June 2006. That is why they want a $1100.00 this month when in fact it should be $828.64.

If there is a lawyer at all that will pick my case up and let me file suit against this company for all pain and anguish they have caused us, confusion and heartache, the embarrasement of a terrible credit reporting especially after already going through a foreclosure... just simply ruiening our lives.. I just need help! I want this fixed and I want out!

We worked very hard for 13 months to show ourselves worthy after foreclosure.... and they just crapped on us!

Buyers beware of this company! They don't hire American's and all of my personal information along with others sits in a foreign country of India! Go Figure! In the meantime, I get the run around and nobody knows any factual information.
