I guess I fell into the same pile of crap that everyone did. I signed an agreement with them on 03/07/2007 to sell my timeshare at the Westin Club Regina in Cancun.

We had a closing date on 10/26/2007 set up with David Harris @ 11:00 a.m., but the Dr. bless his heart got arrested for writing precriptions on the day of closing. Sound familiar? He sure gets arrested a lot!

I am going to go down there next week after I talk with my attorney, and see if I can get the F.B.I. to go with me and put these people in jail where they belong.

If you have your original contract signed with them and have also recieved one from them after you requested to see your signed contract with them you will notice a couple of things that they left out or added to thier version of the second contract.

They left out " Prestige Timeshare Marketing forwards all inquiries about my timeshare/campground directly to me, and allows me to negotiate the sale/rental of my timeshare/campground without the involvement of any broker, and without any commission ".

Also they added " I will not pay any commissions, appraisals, or closing costs.

I understand the marketing fee is a One Time non-recurring, non-refundable, non-disputable charge ". The second sentence of this is not in the original contract!

Also because they say they are not a real-estate broker, but a For-Sale-By-Owner advertising companythey fall through a lot of the Florida statuates.

721.06 Contracts For Purchase Of Timeshare Interests

721.065 Resale Purchase Agreements

721.10 Cancellation

721.12 Recordkeeping By Seller

721.121 Recordkeeping By Resale Service Providers & Lead Dealers

721.20 Licensing Requirements; Suspension Or Revocation Of License; Exception To Applicability; Collection Of Advance Fees For Listings Unlawful

CHAPTER 725 RESALES BROKERS, SALES AGENTS, SCHOOLS & APPRAISALS

If you look at these you will see that because they are not a real estate broker, they are excluded in these laws, and I guess that is how they have been doing this for so long.
