Florida: On March 17, 2010, Virtual Group, Inc. d/b/a Realty Trade; and Boris Harutyunyan; Timur Shasutdinov, a/k/a Tim Harrison and Brian Wroblewski; individuals, (Respondents) agreed and consented to the the entry of an Agreed Judgment and Final Order with the State of Florida, Office of the Attorney General, Department of Legal Affairs. The Respondents entered into the settlement without any admission that they have violated the law for the purpose of resolving the complaint.

Under the terms of the settlement, the Respondents will not engage in any deceptive and unfair practices, including, but not limited to, the following:

Soliciting by telephone any customer listed on the National or Florida Do Not Call List;
Collecting or attempting to collect payment for services without the Express Verifiable Authorization of the customer as required; engaging in Commercial Telephone Solicitation with a license; make any false or misleading statements including that they have people waiting to buy or rent customers' timeshares, they have experienced a high demand for timeshares in the area in which the customers' timeshares are located, potential customers' timeshares will be sold or rented within a short period of time, misrepresenting to customers the number of timeshares sold or rented as a result of their advertising services, misleading customers into believe that sales representatives will personally market the customers' timeshares; misrepresenting the terms of refund, cancellation, exchange or repurchase policies and misrepresenting that they are affiliated with the customers' timeshare resorts.

In addition the Respondents shall offer and provide within thirty (30) days of the customers' request, full refunds to eligible consumers of any amounts paid. Customers that are eligible for a full refund shall include consumers who have received services that were misrepresented and those who notify the Respondents of cancellation with seven (7) business days of receiving the confirmation of the sale.

As part of the settlement the Respondents will continue to respond to any and all complaints received by the Better Business Bureau.

If you've been contacted by a company offering to sell or rent your timeshare the BBB advises using caution, especially if an advance fee is involved. While these companies claim to have ready buyers or renters, imply they are representing foreign investors; or that corporations are interested, most are just offering to advertise your timeshare for sale. Do not confuse the service of an advertising or marketing company with those of a real estate company. In most real estate transactions it is the buyer who puts up a deposit and the real estate company gets its commission from the seller only after the deal closes. Ask if the company's salespeople are licensed to sell real estate or whether they are selling an advertising program. If you're contacted by a marketing service, don't allow the caller to pressure you into making a hurried decision. Request detailed written information about the company's services, find out where they currently advertise and visit other Internet listings the company may have. Most company's can not tell you whether a timeshare has rented or sold because these are generally "For Sale (or Rent) By Owner advertisements. Fees for timeshare listing services can range from $295-$600 with little guarantee that your unit will be sold or rented.

In the State of Florida - the collection of advanced listing fees from Florida residents, regardless of the location of the property, and owners of Florida timeshares is prohibited. Section 721.20(6), Florida Statutes, prohibits the collection of any advance fee for the listing of any timeshare estate or timeshare license, and requires that any seller of a timeshare plan be a licensed real estate broker, broker associate or sales associate as defined in Section 475.01, Florida Statutes.


Be sure to get all promises in writing, but remember that even then, those promises are only as good as the company that stands behind them.

Whoever file a rebutal about Realty Trade/RealtyProperties saying it's allowed to operate due to fundamental changes Is full of crap. They are trying to rebute all the complaint because they are loosing money everytime people do a search. Just look at BBB rating for this company, a big F-. That alone say something about Realty Trade/Realty Properties. Do not do buisness with this scammers. Not unless you want to loose thousands of money.

June 8,2010 as the scammers in realty trade work hard to cover up their operation, I got e-mails from new people that they recently scammed.

here's a copy of  people's e-mail, read up. I deleted the last name and account number for security purposes. We are compiling alot of this people for a class action lawsuit. I have plenty I will post the recent one I got in the e-mail.

I, Ruby PO number Realty Trade Marketing. I was given this information to cancel my contract and receive my refund. I originally sent letter 5 days after my contract was up, they said they got it too early! That I had to wait until the next 6 months was up and send w/i 10 days after. I called just before (Sept. was supposed to be beginning of second 6 months, but found out not continued until OCT, so had to wait another month! obviously they had canceled my first time! , and was told I could send a letter anytime! I wrote 3 letters of cancellation just to be safe. Now I called them to see where my money was and they said It was in the contract the 2nd 6 months was no refund policy. They strung me along to that point! Their people told me different stories every time I called!

Hi, my name is Greg, are you still attempting to pursue a class action suit against realty trade.  I had a 6 month contract with them for selling my timeshare and didn't get any offers and they are refusing to refund the $1,295 fee that I was supposed to be refunded back if I didn't receive any offers in that timeframe.  Thanks

I found your note online and am responding to your email.  I would like to be a part of your class action law suit.  I am a recent customer of Realty Trade and was totally scammed.  They will not return my refund after calling in as requested which I was told not to worry about the letter because they would take care of it with the phone call.
 
Let me know what additional information is needed from me to pursue this class action lawsuit.

RealtyProperties.com is allowed to operate due to fundamental changes in the way that it has done business in the past.  The reason that there were many complaints was due to the wording of the older marketing agreement.  


Since the marketing agreement, sales presentation, and overall business model has changed, we are continuing to operate.  RealtyProperties.com is not hiding from mistakes that were made in the past, but publicly addressing the problems of previous ways and putting forth a plan for the future.

If you believe that you are entitled to a refund under the terms and conditions of the old marketing agreement with RealtyTrade, then please feel free to contact our customer service department.

Why is the state of Florida allowing these scum bags to oppirate and they have and are still lying and scaming the public like always,NOTHING HAS CHANCED,exept they have gotten better at hiding it,now they tell you point blank they have all these buyers now.so let's get scamed right now, before you have a chance to think, they are getting more REFINED in they'r scame, to awoid another law suite..DO NOT DO BUSINESS WITH THIS COMPANY THAY ARE A PURE SCAME..AND NO I AM NOT AN EX EMPLOYEE BUT I KNOW PEOPLE THAT WORKED THERE  AND I KNOW THEY'R GAME,IT IS SICK, SHAME ON THE STATE OF FLORIDA TO ALLOW THIS TO CONTINUE
