I have been the office manager for True Care Counseling LLC for 3 years now. In the early morning of January 17th, 2008, I was accused of shoplifting and assaulted by unidentified security officers at Safeway Grocery in Phoenix. I had just left the dentist's office 15 minutes from getting my wisdom tooth drilled on. I made it to Safeway with my wife and three children, all under the age of 4. They stayed in the car while I went in. I used the SRP machine, then got a banana from the fruit stand. After standing in line for a while, I realized that it's taking too long. I walked back to where I got the banana from , put it down and proceeded to the exit. Outside of the store(approx 40 feet) in the parking lot I was attacked by a man who didn't identify himself as security and he was wearing plain clothes. He grabbed me, threw me to the ground, sat on me and choked me with two different submission moves while another guard was holding my legs. He kept saying ,"What you got." I almost completely passed out from the 2nd choking, but that's when I saw my wife coming up screaming at the men. That's when they said they were security and I stole something. She put her hands in my pockets and pulled out nothing!! They released their hands from me finally. Safeway has failed to take responsibility for this action and is putting the blame on the actual security company that they had hired to perform duties. To make matters worse, the police arrived, took both stories and told me Im not the victim in this matter, even though the security officer failed to reveal his identity outside of the store,my shirt was torn off, I had gravel stuck in my back and the paramedics had to be called on my behalf. I asked the officers to file an assault report and was told they would do it, but it never got filed. The officers even had the nerve to write a 4 sentence report that read as follows:1) Otis attempted to steal banana,2) Otis dished banana before leaving the store, 3)Security notified Otis to stop, 4)Otis assaulted security. All lies. It was hard to find an attorney because of the report at first, but now I have one who is going to make sure that they take responsibilty. They all have gone bananas if you ask me. I was severely injured from this matter and I have medical bills that must be paid. What hurts me the most besides my body and mental status from this is that my kids and wife had to witness this unfortunate incident and I still remember them crying and screaming inside of my head. if true. Please keep us infomed. I do have one question though. In the first paragragh you mention 'three siblings. all under 4 years'. Then later you mention your kids. As siblings would be your brothers and/or sisters, exactly who was with you? Or were you trying to dress up the report to sound important?

You walk into a store, pick up A banana, walk to a checkout stand, wait around, deceide it is taking too long, return the banana to where you found it and exit the store. Don't you find that a little bit odd? IF what you say took place, you shouldn't have any problem finding an attorney willing to take your case. You stated this situation happened around 6 months ago. You should have filed assult charges aganist the two "security" persons. It doesn't matter that they were working for a security company. They were hired by safeway and as such, are acting as their agents. Get on it. Knock off the banana jokes, it won't help your case.
