Frank Delzompo of Sand to Sea Properties did not give us advanced notice of what he would be charging us for cleaning and repairs, and what deductions he would be taking from our security deposit.  This is in violation of California Civil Code 1950.5 and 1940.5(g).  Under California state law a landlord is supposed to advise a tenant ahead of time what he plans to charge them, and what it is for. 

He was the worst landlord we've ever dealt with.  He harassed us during our tenancy and upon move-out he charged us $1,000 to clean the house - including $250 to clean the windows - which any reasonable person would agree is excessive.  He charged us for 4 hours worth of labor at the rate of $45 per hour to repair a bedroom door.  He charged us for drain problems in the property that pre-existed our tenancy.  That is also something that is NOT legal in California.

Even though we asked to be informed of what we would be charged he did not contact us in advance to clear these charges with us, nor give us the opporuntiy to shop around for more affordable solutions.  Upon contacting him for an explanation as to why our security deposit was $1500 less than what it should be, his response was that we didn't leave the house "immaculate". 

California state law requires only that you return the property in the same condition it was given to you in, less normal wear and tear.  It does not require that it be "immaculate" which obviously is a subjective term in the first place.  Bottom line, he ripped us off.  This person should be investigated to the highest extent of the law, which we plan on doing.

Response to Alleged "Rip Off" - WORST TENANTS EVER

One week before they were supposed to move--and after we had already granted them an extension on their lease without a rent increase--these tenants threatened not to vacate the premises as required by law.  We explained to them that we had signed a lease with new tenants and would have to file an Unlawful Detainer (Eviction) if they did not move as promised. 

Three days before the end of the lease, they contacted a moving company and made arrangements to leave.  They then asked me and one of my agents to find cleaners for them, which we did. 

These tenants did not ask what it would cost to clean the house; they did not ask to be "informed" of anything.  

Knowing we had signed a lease with new tenants scheduled to move in on the morning of Sunday, July 1st, 2018, the tenants e-mailed us at approximately 7:30 p.m. on Friday, June 29th, 2018 that the home was empty and the keys were in the kitchen.  They did not ask for an inspection and did not reply to my agent's request for a face-to-face turnover of the keys.  They gave us 1 day to get the place ready for new tenants.

When my agent arrived on Saturday morning, she discovered that the tenants left the house (a 3,300 square foot executive home) absolutely FILTHY; with a broken bedroom door; a shower drain that was plugged with their hair; junk and trash throughout the premises, and the refrigerator full of food and beverages.  We had the cleaning crew there the entire day and into the evening on Saturday.  My agent personally had to load up a truck with their trash and haul it to a dumpster. 

We spent just over $1,400 on the cleaning, trash removal, and repairs.  We returned the remaining $1,100 to them within 17 days of their departure.  NONE of the money went to my company.  The cleaners, the handyman, and the gardener are not affiliated with Sand to Sea Properties, Inc.

In summary--we handled their security deposit reasonably, fairly, and 100% in accordance with the law.

Since July 21st, 2018, these people have harassed and defamed me and my company online, over the phone, and via e-mail to the owners of the premises - precisely as they threatened in writing to do.  I have multple e-mails from them and have forwarded them to my attorney.    

During my 20 years as a United States Marine, and my 15 years as a Real Estate Broker, I have never before encountered such angry, spiteful, and vindictive people.
