Anyone contacted by this company and is verbally abused by any of it's employees should contact a lawyer. It is against the law , you have civil rights. There are certain procedures a collection company has to follow. DO NOT give them any of your banking information!!! Please listen to me and save your self the time and aggrivation. A lawyer dealing with this kind of debt can tell you anything you need to know.

I too have had a terrible time with this so called agency. Their personnel are abusive and confrontational. I have their website address and mailing info for anyone who is looking for them. I will be sending a letter to the BBB and the Delaware Attorney Generals office if they do not comply with my request for proof of debt and valid information. They send letters without account information or proof of debt. Yet they actually expect you to just send them money. Yea, ok... Without limiting the general application of the foregoing, the following conduct is a violation of this section: (3) The solicitation by a debt collector of any postdated check or other postdated payment instrument for the purpose of threatening or instituting criminal prosecution. ). Second SIMMS Assc cannot threaten you with any criminal action ( Refer to: TITLE VIII - DEBT COLLECTION PRACTICES [Fair Debt Collection Practices Act] 807. False or misleading representations [15 USC 1692e]A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section: (4) The representation or implication that nonpayment of any debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages of any person unless such action is lawful and the debt collector or creditor intends to take such action. )I recomend you send a letter to SIMM advising them that they are no longer to contact you by phone. And that any and all communication will be done by correspondance. Second, tape all convertsations in the future if they call again. It is NOT illegal to tape record conversations that may be used in a Civil case later on. It is illegal to use the tape in criminal prosecution. Also let them know you are taping when they call. They must Identify themselvs at the beginning of each phone call. I laso recoment you look up on the internet US TITLE VIII SECTION 8 or 15 USC 1600 and refresh yourself with the law regarding the Fair debt Collection Act.

The address for them you have is correct. I am from DE and have horrible experiences with them as well. Contact the DE Attorney General's Office with your complaint and CC: Simms. When I did this, they finally responded to my complaint. The tele# listed is 302-832-7549. A collector can not threaten you or verbally abuse you. File a Cease and Desist order against them in writing and tell them that they are to have communications with you only in writing.
