For the past one year and 3 months, State Farm Insurance Adjuster MD only want to settle for $2,00 for all my medical bills and $3,000 for future medical bills. My son's medical bills already up to $5,000 and some was paid by the state as I apply for DSHS medical benefits so that my son can get proper treatment. After the accident my son quit his job because of all the pain on his body, he is already had two physical therapies but it seems he is not getting better, now he has depression because of this accident. The last time I talked to the Adjuster MD he told me that he hired someone to do some surveillance video of my son and he saw on the video that my son is riding a bike picking up his son on the school bus. My son is not physically invalid, he has pain and he is suffering after that car accident. Our Privacy has also been violated. The last time I talked to the Adjuster supervisor Mr. Sheldon, he said we are going to Arbitration, we do not know whatwill happen over there if we win or notas we do not have any attorney. Ialready send my demand to the CEO of State Farm and I also ask help to the Insurance Commissioner of WA. but it seems The commissioner is not sointerested in helping my son as they close the case ASAP just for a week. Now I have not heard anything from this Adjuster MD since November and he still on his quest to give us $5,000 for all the loss wages, pain and suffering, future medical bills and now my son still has no job as he is now has severe depression after that car accident. He was sandwich by two cars on a stop traffic lights and the one who hit him accept 100 % liable and state farm accept the liability but no good settlement is on the table.

Your son exercised bad judgement in quitting his job. Quitting would make it appear that he is thinking of this accident as a form of winning a lottery worth millions. I'm not saying those were his thoughtsjust saying it could appear that way. What type of short term or long term disability benefits did the job have? If his employer would have let him go they could have backed this up with some kind of documentation of the job description. That along with some kind of medical documentation stating that he is no longer able to perform the job described could probably have helped him with any kind of negotiation with the insurance company. This could have made the company look bad but at least he would have had an income and maybe another course of action against the employer.

Steve's statement about having a lawyer involved would have been the best course of action. As far as the free upfront attorneys you really need to shop around and ask detailed questions. Although you can get an attorney that will wait until you win your case and take an amount from that, you really need to go over the contract carefully. Some things to look for would be to ask how they break down their fees. An attorney may say they will absorb the court cost and their fees only to turn around and make you liable for any other fees such as getting a specialist involved or investigators. You will have to pay for their fees which can add up.

Some other questions would involve how they would handle a settlement. You mayalso evaluate any consequences from refusing to take a reasonable settlementwhich the attorney should discuss with you in detail.

As far as getting his self confidence back that is up to your son. Everyone that has quit a job and can't find another jobor has been laid off has had some of the same confidence issues. He just needs to put those feelings behind him and start over. You can think of it as when he was learning to ride a bike as a kid. Did he fall off and just say the heck with it and give up or did he just climb back on and keep at it until he didn't fall anymore.

From the beginningsince my son was struck from behind by the SUV of this lady , the life of my son go into pieces.He lost his property the only car that he only owns in his life, he quit his job because of the pain that interfere with his work , he lost his confidence getting another job that will not affect his concentration and pain inside her body and mind, he's memory were now invaded with what happen to him on this accident, he is now suffering with depression , and now the people who are 100% liable for this accident invaded his privacy and maybe the privacy of all family member especially my grandkids. He said that they hired an investigator to see what my son is doing on his everyday life, what is he capable of doing, they took some pictures and videos which they do not want to share with me saying it is their property. That is fine but how about the privacy of my son and my grandkids is that a part of this claims.

He said that on the surveillance, he got a video of my son riding a bike with my grandkids which it is true, because if I have a doctors appointment my son is the only one who can pick up the kids at the school bus stop which is only a minute ride on a bike.My son is not invalid, nor physically disable, he got pain that is on and off after doing some things that he can do but after those things were done I wonder if the investigators and Adjuster MD can see the pain he is suffering after wards.

I wonder if they knew what my son's words to me when my son say the words that he is much better dead on that accident. I wonder if the investigators see that loud shouted words of my son shouting outside the house and throwing everything and saying he is much better dead. Everyday I wrote all his suffering on my notebook but after a while I got fed up on writing about his accident.

My son did not lost his mobility but his emotions turn worse with depression.I am not just the one suffering after this accident, the whole family is and most of all his son who is always there to comfort him and telling him, what he will do when he grow up and help his father.

Maybe if we can afford an attorney we can get a lot of money here on this arbitration but the problem we were declined three times because of some hidden fees that I cannot even pay, another attorney is asking some up-front fees to start the processing of this claims, and another attorney declined us because my son did not have enough medical records to support this car accident it is because the Adjuster MD do not want to accept the responsibility that their adjuster is a 100% liable for this accident.Hospitals, Clinics, Physical Therapies are just asking for a piece of paper (a Letter of Protection as what they ask)that State Farm will be responsible for the payment of all the medical bills of this car accident after we settled.

Because the State Farm do not want my son to get medical help after begging Adjuster MD many times just for that letter of protection granting my son to see doctors, go to hospitals, clinic and therapies, my son fell on depression so I ask help with the State and DSHS give him benefits when they knew he has severe depression and they said that it is a disability.

I even have to asked the Insurance Commissioner for assistance butafter hearing the side of State Farm they just close my case and that State Farm said we are going to arbitration and of course it will cost money as I make a research.

Some people here who read my side think that it is easy to deal with Adjuster and some insurance company who yout hink will take care of your needs if you met an accident. I do not know what is the purpose of thoseinsurance policy and why they are not doing their repsonsibility of paying the right amount to the person who suffer on the accident.

State Farm is trying to rip offmy son of all thethings that they are supposed to pay. For over a year my son cannot work, medical doctors cannot see the problembecause sometimes doctors are also afraid that if this car accident go to trial they need to be a witness and some doctors donot want to be involved. I heard a lot of things like that from friends and news. There must be a law that will support people who got in a car accident. Law that if the person cause the accident and 100% libale, their insurance must pay all the pain and sufferings and not just the medical bills.

State Farm Insurance try to rip off people and do not want to pay for the cause their insurer did.

Your report is confusing and at several points looks like you may not be telling the entire story.

First how old is your son? Putting together what you wrote, your son also has ason who is old enough to ride a school bus. If that is the case why did YOU apply for DSHS medical benefits so that your son could get proper treatment? It sounds like he would be old enough to apply for any "benefits" on his own.

Second, your son had to quit his job, so what did he do? If he is in too much pain to do a job, it COULD be seen that he would be in too much pain to be riding a bike.

You didn't mention anything about the damage to the car. So can we figure that the amount they offered there was acceptable to you?

If their driver was at fault should they coveryourACTUAL out of pocket amount for themedical bills..Yes of course. Should they cover any expected future medical bills..Yes. Butit is when people appear to get "greedy" that InsuranceAdjusters start to get suspicious. Again according to what you wrotein 1 Year and 3 Months the medical billsonly reached$5,000 which is very small. One visit to the ER could run that much, so one must ask exactly how bad was your son injured?

You didn't mention the amount your son is seeking. Butif he is asking anything over a mid-high 5 figure amountoutside of the medical billsyou can bet that any insurance company would do a little more investigation and give him a second look. If you are asking 6-7 figure amounts you can guarantee that you will not only get a second but a third, fourth and fith look.

Oh and asfor violating your son's privacy. As long asall of thevideo recording was donein public where youdonot have an "expectation of privacy". There is a very good chance that no laws were violated and they can use that as evidencein their"side" of thestory.

But if you are 100% honest and not hidding anything then why don't you have an attorney? Personal Injury attornies take cases on contingency all of the time. So you wouldn't have to pay them anything up front, and in many cases you don't even have to pay them if you loose. They will even build their fee into the settlement so you wouldn't be out any money either.

Are you just plain stupid, or what?? Get a lawyer TODAY!!! Why would you even consider handling a case like this on your own without an Attorney??? You obviously have a strong case that any competent attorney would take on a contingency fee basis.

This means absolutely no money out of your pocket. Can you explain why you did not get an attorney on DAY 1??? This level of stupidity simply amazes me.
