08/20/08 I signed a contract to rent two vacation properties from Tica Cabins Rentals, Inc., Blue Ridge, GA for the week of June 28th, 2009, and gave Tica Cabin Rentals a 50% required deposit in the amt of $2,102.50. The contact states under "Cancellations" "A $100.00 administration fee is assessed for all cancellations. However, if Guest(s) cancels less than fourteen (14) days prior to their arrival date, the entire advance payment will be forfeited. No Cash Refunds Are Given! (For a refund of monies, cancellation must be in writing and sent certified mail and received in 14 days prior to arrival date.")

I posted via USPS a certified letter to Tica Cabins on January 26th, 2009 which they received January 27th, 2009, informing them of my cancellation which is 152 days cancellation notice prior to arrival on June 28th, 2009.

After many attempts to speak to Thelma Coffone, Owner, she finally returned one of my many phone calls and told me she would refund me 50% of my deposit in 12 days and refund me the remaining 50% in 12 days after that date. Then Thelma Coffone e-mailed me stating she would not give me a refund because I took out travel insurance. Which I did in case of a death in the family and/or illness. I told her my cancellation was due to economic reasons.

Thelma Coffone @ Tica Cabins took it upon herself to contact the travel insurance company which I purchased through Tica Cabins and had them send me forms to request my deposit back due to medical reasons. I did not have medical proof as this was not the reason and phoned the travel insurance company and informed them of this.

I tried to contact Thelma Coffone @ Tica Cabins and tell her this would be insurance fraud but she would not return my phone calls and I still have not received a refund.

On May 18th we refunded the entire amount of money that Ms. Rastetter paid for her reservations. This was due to the fact that CSA Travel Insurance notified us that they could not pay on her claim. She said that the cancellation of the reservations was due to her loss of her job. Per CSA, she did not meet the time requirements of being on her job so CSA could not give the refund. We refunded the full amount that she paid including the normal cancellation fee amount that she would have been charged as well as the premium for travel insurance. According to CSA Travel Insurance this claim was handled properly. We are not allowed to give a refund and also allow someone to file a claim for a refund with the insurance company. I don't think that Ms. Rastetter wanted to receive a double refund. I believe that she just wanted her money faster than the system would allow. I am somewhat surprised that she did not post here that she had not only gotten her refund but that we also gave her the full amount that she paid and did not keep any fees out of her refund.

I have not heard from Tica Cabin Rentals since their rebuttal of April 17th and my response to theirs on May 5th. Again, I contacted CSA Travel Protection today May 12th and they AGAIN informed me that they are not responsible for Tica Cabins refund and insurance is denied. I sent Tica Cabin rentals a certified letter informing them of the insurance companies response, again. I asked Tica Cabin Rentals via certified mail to please settle with me and did not receive a response as they know they are in the wrong and are delaying in refunding me my deposit. Kathy R

CSA Travel Protection DENIED the claim. According to the contract between Tica Cabins and myself Thelma Coffone, CFO, at Tica Cabins owes me a refund as I followed the contract as stated to send a certified letter before 14 days of arrival date for a full refund. My certified letter was sent requesting a refund 152 days before arrival date. After contacting an attorney I have every legal right to receive a refund directly from Tica Cabins due to the fact that I did as instructed in our contract and requested a refund 5 - 6 months in advance. This is much more advance notice than the 14 days requested in the Tica Cabin contract. By the way, Tica Cabins tried to convince me to file a claim for "medical reasons." I have the original claim forms with a note from CSA stating Tica Cabins instructed CSA to send me the medical forms. I was not cancelling due to a medical condition and refused to commit insurance fraud. After many, many attempts to collect my refund from Tica Cabins I contacted CSA Travel and informed them that Tica Cabins insisted the insurance would cover for them. CSA Travel sent to me claim forms to try to collect insurance on Tica Cabin behalf and again, the claim was DENIED. Kathleen Rastetter, Cumming, GA

When Ms. Rastetter cancelled her reservation, we told her that she would receive a refund in about 12 days. The refund would show 2 separate entries on her credit card since it would need to be run once on each reservation she had with us. When we attempted to refund her money it was discovered that she had purchased travel insurance to cover her in case she had to cancel. We contacted Ms. Rastetter to let her know that we couldn't run the refunds as promised and that she would need to contact the travel insurance people. Her refund would come from them. We gave her their contact info,. We called the travel insurance company to be sure we had told her correctly since this was the first cancellation we had since we began offering travel insurance. They took her info and said they would go ahead and mail her the claim forms to expedite her refund. The next thing we heard was from American Express that she was attempting to charge back to us the amount that she had paid. I provided American Express with documentation showing she had purchased travel insurance and that the refund would come from the travel insurance people. American Express denied her charge back and did not refund her any money. The next info we received was what we read here on Ripoff Report. I checked with the travel insurance company about 2 weeks ago and they still had not received any claim forms back from Ms. Rastetter so they could not begin to process her claim. I received a letter from Ms. Rastetter advising that she was reporting Tica Cabin Rentals to the Better Business Bureau for not giving her the refund. I have not received anything from the Better Business Bureau. I called the travel insurance company today (April 17th) and they advised that on April 13th they finally received the claim forms from Ms. Rastetter and they are processing her claim. I do not understand why Ms. Rastetter refused and then delayed in sending in the claim for the travel insurance refund. That is why she paid the premium and purchased the insurance originally. The purchase of the travel insurance was completely optional but she purchased it so she would have protection in case she had to cancel. Tica Cabin Rentals has followed the correct procedure for this type of situation according to both CSA Travel Insurance and American Express.
