Complaint Review: UNISERV POOLS LLC - Ft. Lauderdale Florida

The below was sent by our attorney to Ms Diaz Barreto, The originator of this complaint.

To:       Ms. Diaz Barreto

Re:      Cease and Desist / Unlawful Actions

Dear Ms. Diaz Barreto:

The purpose of this letter is to have you cease and desist from continuing to make false and libelous statements about our client, UniServ Pools, LLC (UniServ). We have been advised that you have filed numerous false complaints and published untrue statements concerning UniServ even though you are not a client of UniServ.

In fact, you have already damaged UniServ with these spurious complaints.  You should be aware that the moral and legal climate regarding attacks placed on social media have changed.  Courts are now often finding that purposefully untruthful attacks may lead to civil prosecution.  Please note the following:

It is our understanding that;

• You never paid UniServ for service.
• You never had a service contract with UniServ.
• You paid monies for service to a third party that is not UniServ.                                             (Echopool is not UniServ and neither is Mr. Bosnic)          
• The monies you paid to that third party were not invoiced by UniServ.
• Finally, we understand that you were made aware of all of these facts but proceeded with a widespread and far-reaching campaign of slander, false accusations, and personal attacks against UniServ and its employees.

The above actions have caused my client serious monetary harm and immeasurable damage to their reputation.  Ms. Diaz Barreto, you make take some sort of unreasonable satisfaction in your actions, but please be assured that neither my clients, nor the court system, find such matters amusing. 

I advise you in the strongest possible terms to cease and desist from any and all public attacks upon my client.  I further advise you to immediately rescind and remove all complaints already made against UniServ.

If you do not take the actions recommended here, please be prepared for legal action in the immediate future.   At that time, you would be well advised to retain your own legal counsel.

Govern yourself accordingly.

Per the above complaint, Ms. Melba Diaz Barreto at xxRamblewood Drive, Coral Springs, FL 33071, wants a refund of a check that her husband wrote, signed, and mailed to a Mr. Predrag Bosnic. She has, maliciously and unreasonably, included UniServ in this complaint.  Please note the following:

• As Ms Diaz Barreto herself states above “I sent UNISERV emails (that I still have) refusing their services.”  We could not agree more. UniServ offered her services at one time which she declined.  That’s the end of it!  UniServ does not have any business relationship with Ms. Diaz Barreto, and never did.  She never hired us and never paid us.
• Ms. Diaz Barreto further states: “Now the pool guy from ECHOPOOL works for UNISERV but as an independent contractor.”  Untrue!  This person she is referring to owns his own company and does not work for UniServ, either as an employee or as a subcontractor.  Whatever business they may have done together is between them and has nothing to do with UniServ.
• We understand that Ms. Diaz Barreto’s complaint is that she paid Mr. Bosnic for services he provided to her from invoices he sent to her from his company. It seems she now wants a refund. UniServ is not Predrag Boznic nor employs his company.  Mr. Bosnic is NOT UniServ!
• UniServ has been the undesired recipient of innumerable and unending phone calls from Ms. Diaz Barreto. UniServ was not involved in this transaction yet she refuses to accept this or end conversations when we politely tell her as much. This issue has nothing to do with UniServ!

Ms. Diaz Barreto is not our customer.  Her actions towards UniServ constitute fraud, harassment, libel, and possible extortion.  We intend to pursue her to the fullest extent of the law.  Truthfully, her mental stability and/or honesty are in question as she continues to pursue UniServ for a grievance she has with another company, a competitor to UniServ, over events which we were not part of, nor privy to.
