I have an insurmountable amount of personal student loans that are in default or near so... I had a terrible accident that left my back in bad shape and was unable to finish school. I can only work to get by and pay the basics which does include payments to my student loans backed by the federal government.

I was in school for court reporting and live closed captioning. I borrowed extra money via a personal loan to buy a high tech stenography machine, lap top, and very expensive software, the loan was advertised on a info board at school for wachovia to borrow up to 40k/year extra outside of the stafford loans.

I tried to finish school asap, so i could pay off the loans, but the accident left me out of work/school for several months, and I have so much back pain i cant sit still, which is what court reporting and captioning is all about. It is easier for me to wait tables and keep stretched out believe it or not. i have pt and chiro visits 3times a week and its two years later, but it helps me keep the weight off and stay stretched out so i can work to get by...

Anyway, van ru out of largo, florida, has threatened me in everyway. a debt consolidator told me to ignore them as i was going thru them at one time, but couldnt afford their payments either. the lady was nice there though(debt consolidator) and told me they cant take my car, its a paid off hyundai 8 years old and worth little, or garnish my wages, or lien on my trailer home, which is a double wide on rented land in a mobile home park, which i am upside down on its value, she said in the state of florida they cant do these things they are threatening and said it is one of the few states they cant do these threats on personal loans. They started through wachovia called educaid select loans, and have been sold and tossed around to many collectors ending at van ru here in florida.

I understand the goverment backed stafford loans they can do these things, but i am able to pay them. I cant afford the personal loans and was just curious does anyone know these statements about florida? I have also used all deferrments for the personal loans...I am full-time server at a major theme park company, have major back problems and need surgery, I have the protection of family medical leave act, because i have to call off work atleast six days per month due to severe pain from my job. i work four/13 hour double shifts in a very busy restaurant and it kills me.

Surgery is on its second opinion, two years in a row (i keep putting it off because i cant afford to be out of work for 6 months)and both state it will be about 70% successful. Im afraid it could worsen my condition and i would be out of a decent job with full benefits... HELP!!!

First understand that nobody can take any personal property from you without suing you first and getting a judgement, with the exception of property used as collateral on a loan.

These debt collectors have most likely violated federal law in that they have violated the FDCPA.

They can garnish your pay, and the max garnishment in FL for civil judgements is 25% of your income which will cover all debts combined.

School loans are subject to a higher level of collection activity, but they still cannot take your primary residence or your only vehicle, and there are stricter rules on garnishment of any retirement or disability income or unemployment.

Never use third party debt "consolidators" as you call them. That is just asking for trouble. It costs you more money and opens you up to more risk, when there is nothing they can do for you that you cannot do for yourself.

Your best option would be to file for SSDI and any other public assistance you can get and then file for bankruptcy. Then your only remaining obligation is the school loans, and the bankruptcy court will determine how much you pay them per month.

Somene replied and recommended disability. I have often thought of that when im on my last leg at work, digging to take that last table for that last tip, kowing i will have to call fmla(family medical leave act) the next day or so due to the excruciating pain i feel right then. the two to three days i can make it get me by and i push through the pain and try not to use any perscribed pain meds out of pride or being smart (addiction). I just see others in my situatiion whom are able to do less, and they are denied disability, so that has discouraged me. But as i approach 45 years of age, its becoming reality. I will check into it though. I am just more concerned about the recent threats and trying to protect my job, home, and threats of asset overtakings that i do not longer have due to sell(car)!!!
