Karen , Like you and others. My husband and I have our Mortage with Vanderbilt,after Oakwood last in bankrupcy court. Vanderbilt claims we are 3 months in the rears with our payments. We wrote laetter after letter to them, and tried to speak with them on the phone, no luck. In Sept. 05. I get really mad. We were trying to re-finance our home ( to get away from Vanderbilt.) and Vanderbilt refused to give to the payment balance in the hopefully new mortage comp. That's when I wrote to the governor of my state...Attorney General..FTC.... and the state dept of financial institutions...and I did so in each state that Vanderbilt has an address. I also hired a lawyer. Who is looking over my cancelled checks, and has challaged vanderbilt to proved we've missed payments.. The wheels of justice slow very slowly.. Just hang in there...and keep everyone posted on your progress.

Please tell me you paid the extra $10 instead of getting your credit ruined. I agree what they are doing is not right and I have read many reports on here about Vanderbilt and even though I think most of them are unfounded, you should never sacrifice your credit for $10. It will cost you much more over the long run with bad credit and is just not worth it. Pay the extra amount and then choose to fight them over it.

Yesterday I got a letter that Vanderbilt CC: to us(sent to the director of consumer credit bureau. They told him that the extra charge on my account was from 1999 and they would forgive it. There for since I had already sent in one payment to them with the extra charge on it, they would be sending us a refund of that money. I know that is one check I will not cash because I did not send them any extra money on any of the payments that I made to them. Sounds to me like they are hoping I will cash it so that they can add more charges to the account. I still have not gotten a new payment book or a balance due statement, so I will not give up until I do. I made complaints to the State Consumer Credit office, to the Tennessee Better Business Bureau, the FTC, and the Attorney General. So far all have made seperate attempts to correct this issue except the FTC (they can't investigate until more people like all of us make formal complaints to them). I still keep all records in writing and since I told them that all correspondance must be in writing, they have not called once. When I made my commplaints to these various Offices, I made sure to include a copy of all checks, faxes that I sent, and notes that I had taken on who I talked to, what time of day, date, and all conversation. Hopefully, this will eventually get solved. If you all are interested in banning together let me know. They may not have ripped me off like they did some of you, but they would have had a not already know what kind of stuff they would be pulling by reading all the post here.

Karen, I know all about this. We have our mortage with vanderbilt. I filed complaints with federal trade commision Oklahoma state Dept. of Financial Instute Respa (HUD) State Resprenstive Get an attorney...

Hey Karen, I know what your talking about. I also have Vanderbilt as my mortgage company and they just want to take your money which if I say so my self they are very good at it. I also went to attorneys to straighten it out and no help because I'm from Germany and they say if only my co-owner signed it and not me then we could get the contract voided but since I'm on it we can't I Don't know why they assume that I know everything in English. I hate that seems like attorneys help criminals more than the victims. I can't believe that this free country can rip people off and get away with it because the government doesn't care about it's citizens at all. It's sad but it's true.

Well, here it is Sept, and still no correction or contact from Vanderbilt. I filed a complaint with the BBB also. Yesterday, I got a new payment book (which I had been asking them to send a new payment book with the corrected amount owed on the monthly payment) Unfortunately, this one still has the wrong monthly payment amount on it. I have sent fax after fax To Roel with no response. They are still cashing the monthly payments that I am sending in. I am making sure to write "Paid in full for ???" (month and year) payment on each check. I am also sending the through the mail with priority mail and tracking confirmation so that I have proof of what day they received the payments and make sure that they are there before the due date. Guess that is all any of us can do at this moment until some government agency gets busy and gets these people straightened out.
