This dealer took my trade and paid it off. Then they sold my trade in. They then cancelled the check for the payoff.

Now they say after 4 months of having the car I purchased they cannot do financing and are demanding I give the vehicle back with a payment for depreciation. 

They are also not giving my money for my trade in back.

 Without knowing all of the details there are some things you need to look at and a visit to a laywer may be in order.

First in some situations and States, if a dealer fails to complete the financing they promised you within a period of time(such as 30 days).  Then they are in effect "stuck" with the Contract, where even if they are unable to secure financing they must then allow you to make payments to them just as if they are the lender.

Second, again in some cases once a dealer sells or otherwise gets rid of the trade they again have afirmed the contact and even if it bounces back later where you can't get financed they may legally be required to keep the contract.  This may even apply in a case of if they have a provision to cancel the contract if they can't get you financed.

Negative things that may affect you is that if in that 4 month period you never made a payment that could be seen as bad.  However, again it may be weighed against them not getting you financed. 

The only reason I am suggesting this is because of the length of time.  Had this been within 14-30 days they probably would have the legal right to cancel the deal, and charge  you for the "rental" of the car during that time.

So I don't want to give you false hope, but if they did do something against the law you may be able to get restitution against them.  Which at the very least may be the money they owe you for your trade, at most could be a signficant amount of money in additional punitive damages.

 Once you signed away your ownership on your traded in vehicle it became THEIR property to do with as they saw fit. Selling it to recoup any financing costs is a COMMON event. What is happening to you is that no lender wishes to supply a loan to you. What this means is that your "purchase" has NOW become a "lease or rental" which means that in order to ensure they get their payment that they keep the check until the vehicle is returned and any "rental" fees are paid off. Whatever is left over AFTER those fees are paid is what you are going to get back. Everyday you hold out on returning the vehicle is going to stack up a ton of rental fees.
