I purchased what was thought to be an 8 GB Apple Ipod Touch, when I got home and opened the item there was a deck of playing cards and a crumbled napkin to keep them steady. Someone in the past purchased this item and did the swap and re-heatsealed (the plastic wrapping around box) and returned it as new and unopened. Walmart says they wouldn't have put this item back in the cabinet for purchase and that there is nothing they can do. I am out 303 dollars and some change and have become the victim of retail fraud.

it's Walmart that put it back on the shelf? How do you know it wasn't shipped that way from wherever originally? You have absolutely no proof but I guess the Wallyworld bashing is in vogue when you are clueless.

The item was shrink-wrapped but the loss-prevention manager stated they didn't have shrink wrap.. My thought is it got returned during the Christmas return time frame, and if Walmart's policy is not to put these type of items back on the shelf, it slipped through the cracks with all the other returns.? Anyhow, Walmrt did the right thing and exchanged the item and I got the ipod I payed for! It did take a complaint to the BBB, Walmart corporate, and LOTS of talking to the store manager and threats to go to our local TV news consumer watchdog reporter. The night I went to pick it up I was to ask for the assistant store manager-she knew all about it and would make it right. She "couldn't" come and sent one of the flunky "assistant-assistant" managers out, bad attitude and all. Never recieved the first appology. I know its easy to say you won't go back but after this there is no way I will, or recommend anyone to shop there. I know some employees and ex-employees defend this company but after this happened I have done a lot of research on things like this and it happens way more than it should.

In response to the person who went to walmart and purchased an apple ipod and got home to find out there was a pack of cards in it and someone would have re-sealed the package. First of all, as being an ex- walmart employee, you only have 14 days to return any ipod or similar merchandise from the day of the purchase, and when returing such item, it is checked not only by the return desk, but by the electronics manager as well. They check to verify that all contents inside are correct or marching to the item sold and check the serial number which comes with all ipods. Once an ipod has been sold the register tracks the serial number as record of it being sold. If you happen to have returned one, walmart does not place the item back on the shelf. It is returned to the vendor. Walmart does not repackage ipods and re sell them. And as a consumer myself, when i purchase anything electronic I make a point to open all boxes before i leave the store to check my mercahndise because I know there are un honest people in the world.

If not-why would they not examine what was returned to them? I have purchased such things as sachets from stores and heard the same excuse from management. I think they do this hoping on one will return so they can make money. Also check things you purchase on the discount table. A lot of times companies do not bother to discount the item because they hope you will not see or return.

Employee theft. An employee took the Ipod to the back of the store. Removed the item from the box and put in materials to stuff it. The employee then shrink wrapped the item and put it back. I had something similar happen to me with a DVD that I bought. However, since it was a DVD I was able to return it with no problem. They had similar complaints and caught an employee in the act. That was the only reason I was able to exchange it for a new one.
