Xlibris Publishing Xlibris doesn't pay royalties to author's Internet, Indiana
I published with Xlibris back in April 2010. It is now November 2010 and I am still trying to collect my royalties from this company without results. I am really sick and tired of hearing to the cheque is in the mail from these people. I have two books with them. Not only did I have to change representatives because the second one I worked with couldn't understand a word of English and made it impossible to work with him, but there is many discrepancies in my royalty reporting. I have been investigating companies selling my book as well as talking to fans and people who have purchased my book, many have not been reported on my royalties showing on my xlibris website. So author's beware, xlibris will take your money and not pay you royalties and if they do end up paying you royalties you might want to investigate to see if they are the correct amount owed to you. I agree with author's who posted on here and their claims of being ripped off by this company, because I have.

Get a copyright attorney from Indiana

I would suggest googling a copyright attorney in Indiana. I found one listed.
My thoughts are:
It could take them a few months to get the sales reports and update your files if they get quaterly reports from the resellers, but
If you aren't happy with the royalty statements:
You can go to an arbitration with them and request the records from the print company they use to see how many books have been printed and shipped, and request the records from the online ebook retailers. All records on the printer's and reseller's letterheads notyour publisher'sletterhead. If they won't provide this for an arbitration then you can file a case in court. After that you can get all the information from the resellers and the printer with a subpoena and find out how many were printed and shipped, and downloaded.
I would thinkdistributing your copyrighted materials unpaid for without your permission is criminal copyright infringement. That's a federal crime. Call the FBI and report it. (they don't have permission to distribute without paying) Check with a copyright attorney on this.
It'sup to a$250,000 fine and up to 5 years in prison for copyright infringement for each count.
I know the other post says they are being sued in state court in Indiana, but a federal crime and the FBI, now that has teeth. And it's possibly wire fraudif they use the phone lines and internet to defraud people.
You need a copyright lawyer and fast! There could be lots of money owed to lots of authors. That's a good payday for a sharp copyright lawyer. Go class action.
All this of course only if they aredefinately not reporting all your royalties and are distributing without telling you all the sales numbers.
