I witnessed Judge Diego H. Edber violate a criminal defendants constitutional and civil rights.  A criminal defendant was in his courtroom fighting a criminal case.  The criminal defendant’s attorney was running late and had not arrived in court.

 The defendant’s attorney called and informed the court clerk she was running late due to another defendant she was representing in Orange County.

Judge Diego H. Edber went ahead and called the defendant's case knowing the attorney was not present to defend the defendant.

 Judge Diego H. Edber started questioning the defendant about the case without attorney representation.  The defendant was confused and scared of what this judge was doing.

 The defendant told Judge Diego H. Edber he wanted to wait for his private attorney to arrive to defend him.  Judge Diego H. Edber ignored the defendant’s request and kept intimidating and pressuring the defendant to answer his questions.  The defendant responded again to the judge he wanted to wait and speak with his attorney when she arrived to court.

 Judge Diego H. Edber became enraged and incarcerated the defendant immediately.  Judge  Diego H. Edber ordered the Sherriff deputies to handcuff and drag the defendant to the LA County Jail.  The Sheriff transported the defendant to the LA County Jail against his will.  This judge also placed a $100,000 bail on the defendant and immigration hold for deportation.  The judge also retaliated against the defendant by charging the defendant with contempt of court.

 Judge Diego H. Edber placed an immigration hold for deportation on the defendant who was born in in the U.S.  The defendant was a U.S. Born Citizen and was not an illegal.  Judge Diego H. Edber racially profiled the defendant because of his Latino ethnic ancestry background.

 Judge Diego H. Edber was not successful in deporting the defendant and the defendant obtained bail on a $100,000 bond.  The contempt of court charge was later dismissed  by a supervisor Judge after hearing  the judge had retaliated against the defendant.

 The defendant filed a complaint with the State of California Commission on Judicial Performance on the grounds that Judge Diego H. Edber intentionally and maliciously violated the defendant’s U. S. Constitutional and Civil Rights.  The defendant also filed a second complaint for retaliation and abuse of judicial power against Judge Diego H. Edber.
