While selling my house my Realtor called them for the septic inspection. I've never used them before but my Realtor said they were cheaper so we decided to give them a try. When we got the report back everything passed all the way down the inspection report until the very end where they wrote "Non-Functional" with no other information. I’ve only owned that house for a couple years and the company that inspected the tank when I bought it said the tank was one of the best they've seen so I was immediately suspicious.

I called Kingman Portable Toilets to ask what this was about but the first person I spoke to didn’t seem to have any idea either so he took my number and said he would have the owner call me back.

After the owner, Ed, finally got back to me he angrily claimed there was a new state regulation passed in 2001 which prevented him from approving concrete septic tanks. This was strange to me because I bought my house and had it inspected by another company long after that. Also, I’ve worked in real estate for 5 years never heard of such a thing. Furthermore, they worked on this septic system before I bought it and had to pull the permit both times, so they should have known how old the tank was and should of informed me that they wouldn’t be able to pass it.

With the closing of my house put on hold, I spoke with several other companies, none of which have heard anything about this regulation but one company was nice enough to go right out and do an inspection. Unsurprisingly, my septic system passed, but now I had two septic bills to pay.

I called the owner of Kingman Portable Toilets back and he continued to give me the run around, often changing the reasons to why my septic system was failed, but he eventually kept going back to this regulation (although the year changed a few times) so I called the Arizona Department of Environmental Quality (AZDEQ) and Mohave County Arizona DEQ, both of whom confirmed to me there is in fact no such regulation.

After much back and forth with the owner he eventually agreed to give me my money back and took my mailing address. Two weeks later I still hadn’t received the promised check so I called the guy to see whats going on and was immediately hung up on. All later attempts to call him result in my call going directly to voicemail and messages never returned.

Through my investigating during this whole thing I've learned this company has been doing this to many people recently so I decided to get the word out to hopefully prevent this company from scamming anyone else. If you’ve been already been scammed by Kingman Portable Toilets I highly recommend contacting the Arizona Attorney General & the BBB.

This response just further proves my point and is exactly why I decided to file this report to warn others. All they've done this past SIX MONTHS is waste my time giving me the run around, never any answers, and lie. I can tell by looking at my phone bill they never tried calling me back.

If they really were going to give me my money back as they've been promising for months they would just call me to get my address again. Ed and I exchanged probably over 40 calls, I don't believe they lost my number but they clearly remember my Realtors name and could have passed on a message through her.

They don't do what they say they're going to do and they can't explain the things they have done, this is no way to run a business or treat customers. Anyone can call the Mohave & Arizona DEQs like I have done to get to truth of this matter.

I am beyond tired of dealing with this company at this point, if they want to return my money as promised I will happily take it and remove my report.

I, Deryl D. Nielsen am the lawful owner of Kingman Portable Toilets, 1010 E. John Norman Lane, Kingman, AZ 86409. Edward Greene is an employee. He is the manager of the septic side of my business.

My company was asked by Kingman Home Realty, Maura Greene, Realtor, to do an inspection of the septic system at 3676 E. Canary Lane, Kingman, AZ parcel 324-02-035A. The inspection was done July 17, 2019. The property was under contract to be sold.  We contacted Mohave County to obtain a septic permit.

The permit we received was for leach field repair only. Upon digging the tank and pumping it, we found it to be a homemade tank of cinder block. We completed the ADEQ Report of Inspection of an On-Site Wastewater Treatment Facility. We stated on our report page 1 of 7: 5 E: homemade tank. Page 2 of 7: E 2: homemade tank. Page 4 of 7, 8 B: homemade tank and page 6 of 7 under #11 other comments: home made tank. #12 A as not functional.

A homemade cinder block tank would not meet the requirements of The Arizona Administrative Code Title 1 Chapter 9 Section A314 “Septic Tank Design, Manufacturing, and Installation for On-Site Wastewater Treatment Facilities.”

Furthermore, it likely is not water-tight and would violate the provision of the Arizona Administrative Code Title 18 Chapter 9 Section B301-I sub-part “e” which states “The discharge from the facility does not create any environmental nuisance condition listed in A.R.S ss 49-141.”

A leaking homemade cinder block tank may also potentially be classified as a cesspool which is patently illegal and allowed under no circumstances in the state of Arizona. The Arizona Administrative Code Title 18 Chapter 9 Section A309-A part “4” states “A person shall not use a cesspool for sewage disposal.”

We charged Mr. Patterson our normal rate to dig and locate the tank $50.00 plus the fee to pump, inspection and provide the ADEQ report $225.00 for a total of $275.00.  We do not repair systems so the result of a system passing or failing has no bearing on our charge. We are not able to determine a septic systems condition or working order until it is dug, the lids removed, the tank pumped and inspected.

 It is clear Mr. Patterson did not accept our Inspection report and chose to have another septic company inspect his septic system. The result was this company passed the system as functional.  We did not scam Mr. Patterson. We preformed the work requested by Mr. Patterson and his realtor.

We charged the same rate as all other customers. I feel the ADEQ report given to Mr. Patterson did not contain the result he wanted. Mr. Patterson told Ed Green when he purchased this property (date unknown) the system passed. Does the new owner of this property know this is a cinder block homemade tank?

At no time did Ed Greene tell Mr. Patterson a concrete septic tank would not pass. There is a difference between a manufactured concrete tank and a homemade cinder block tank.

Mr. Patterson spoke with Ed Greene, our employee, several times about the result of the inspection. Ed Greene tried to explain the results and why this system was not functional.  At no time did Ed Greene convey to Mr. Patterson he was the owner.

After speaking with Mr. Patterson on more than one occasion, Mr. Patterson told Ed Greene he did have a second company come and they passed his septic system. After a threating conversation from Mr. Patterson, Ed Greene told him we would refund his money, and was given an address in Pennsylvania to mail a check. I am not aware of the date of this conversation.

Ed Greene lost the address and did attempt to call Mr. Patterson back. Ed Greene admits he did receive one voice mail and did attempt one more time to contact Mr. Patterson to let him know we needed an address. As of this date I do not have a mailing address for Mr. Patterson.
