1st American Mitagators took $750 from me on 11/13/12 to begin a loan modification .Upon second thought I decided to terminate my contract with them per their instructions on the contract which read: "Client may terminate this agreement without charge at any time prior to the completion of services with written notice of cancellation." Made a phone call on the 11/13, which wasn't returned till11l/16 by a rep named Emmery.

I sent written notice  of cancelllation on 11/14/12 and  it was received by 1st American on 11/16/12. On 11/19 I received a call from Mike Roundtree (Emmerys Mgr.) informing me there are no refunds. I informed him nothing had been completed, and he said it is 51% completed.

On 11/28  received a letter saying contract has been closed per my request and still have not recieved any money back. Emmery informed me today that there is not refund due to my termination of the contract.

Services were not completed when I terminated this agreement and I sincerly hope you will comply with the terms of your agreement which say a refund will be given.

There are no mischaracterizations here Gilbert. Facts speak for themselves. I went through a similar process with your company which demonstrates a pattern of your law office practices. I too paid a healthy $2500.00 to your company for the same services, got the same lip service and received nothing. No I take that back, what I did get was a false sense of confidence that you and your team could do anything at all to help me. You knew that on the day I walked into your office and offered to secure a mortgate modification and you never did it. I literally just gave you $2500 of my money because you assured me you would have no problem getting a modification for me or at the very least a forgiveness of my house payments in default. You and your group are the very type of attorneys who are characterized as ambulance chasers. Your group finds people who are grief stricken, alone and have no where to go and you grab them up, offer them anything you think they need to hear to pay your fees, then its over. They are no better off than when you met them and maybe even worse, homeless. I will never forget my experience dealing with your office and I learned a great lesson about you and your comapny and I am only too happy to tell people alternative ways to get help other than to contact you. First to set the record straight- our firm has gotten over 3000 modifications for our clients- this is a provable fact.  We have a very high success rate but, like any professional matter, we do not succeed 100% and in some instances, clients are dissatisfied enough to post complaints.

Second, when clients come to us, they need help. Some are facing sheriff sale- when a new client arrives we go right to work. We have to- a single lost day might cost someone their house to a sale. Our process is designed to immediately address the client's situation without delay. We are extremely mindful of our client's circumstances- people come to us because they need financial relief.

Our full fee is more than the amount claimed here, we do not wait until we are fully paid for our work, we go to work immediately and complete the services in our contracts as fast as possible. A very large amount of the work we do is done in the first hours of a file. The bulk of our labor is getting the client file ready for the lender.

Despite the large number of clients we have had, a few do sometimes feel aggrieved and will post complaints. When this does happen we do reach out to resolve them. We will be looking into this matter and post a further update as we attempt to resolve this.

Readers of this site should also know that, when we have felt we have not met our guidelines and standards and where it is appropriate to do so, our firm will refund fees.  This too is provable fact.

1st American does not operate fairly in my opinion. They say a refund will begiven if modification has not been completed. I hadn't even sent them all of my paperwork yet!!!My mortgage co. hadn't received anything from them either.

I followed all of the rules and still not one person is "Reaching Out to Me." My next step will be the  Better Business Bureau and also Bill Schuette, Mi Attorney General.
It is as if they are avoiding me. I tried to get my initial $750 returned amiably, but to no avail.

I will update this report if and when perhaps Mr. Gilbert Borman (whom I believe to be the owner)
decides to reach out.
