On Thursday, June 21, 2007; a lady by the name of Ms. Lee left a loud message on my answering machine that said several attempts had been made to contact me but I have neglected to call back and that my attorney was to contact them about a debt from 2005. No one from this particular company had previously left me any messages and beside it comes up on the caller Id as Hackenshack, NJ..who in there right mind would answer a call from somewhere like this.

When I got home from work; I listened to the message and returned the call only to get a hateful lady that would only tell me that I had 48 hours to Western Union 325.99 or I would be prosecuted and charged with a 4th degree felony in the state of Kentucky. I replied that I did not have those type of funds but would be willing to make payments. She replied that this was unacceptable and that only the payment in full would be accepted. I stressed for days about how to pay for it.

On Friday during my lunch break; I once again called this ACA Recovery and informed them that I was having a difficult time coming up with the money and they informed me that I only had 24 hours from the first time I called. For some reason Ms. Lee has been unavaiable each time I call.

On Saturday the 23rd; I once again called because I was worried; I then got a lady named Ms. Banks who seemed to be pretty nice. She advised me that the payment had to be made that day.

I told her all I had was 100.00 to spare at that time; she informed me that if I made any other payment besides the full amount that my account would go into default and automatically be referred for legal restitution; she told me to Western Union it and that the remainder had to be paid by Friday the 29th; I told her that I would try but there were not any guarantees. She always told me that she would have to speak to their attorney whom was coming in the door at that moment to ensure that the payment was alright.

On Saturday the 30th; I Western Unioned yet another 100.00 because it was all I could spare. I received yet another phone call on July 3 stating that I only had until the 4th of July to Western union the remainder 125.99 or they would have me charged with a 4th degree felony. And Ms. Banks was now rude with me telling me that she is tired of my excuses and that it is always something with me.

First off, she does not know me and I have never gave her excuses. I want to take care of this but I just needed a little time. She claimed that she had no say so over my account and that I could only speak to Ms. Banks; and that the payment should have been made on Friday. I was then told to call back on the 4th of July and speak to Ms.Banks.

Now I am even more stressed after reading the information about this company on this website. I feel like I have been scammed.

Businesses will not admit any wrong doing instead they will claim u are slandering them like all businesses have done in the past. good businesses will try to resolve the problems & bad businesses will claim u are slandering them & will file legal action agaisnt u if u do not retract your statement.

I decided to return the phone call to Ms. Lee this morning (July 4). She claimed that my particular case would be forwarded to Norman Kalina in the morning for legal process. I told her that I have been more than willing to settle this debt and that every time they have called; I have sent them money. I asked her if she was a law firm. her reply was that she was not a lawyer but Norman Kalina was and he was not currently in. I wondered why a lawyer would work at a collection agency. I also asked her if she had ever heard of this website and she replied that she had better things to do than search on the internet and try and get out of debts. I told her that she and her co workers have on more than one occasions referred to themselves as a law firm. I also brought it to her attention that I was threatened with 4th degree felony charges and warrants. She asked me if I had proof; and that if I did it would not be liable because if I would have told Ms. Chase it was being recorded that they would not have said it. I told her I wanted in writing how much I have paid and how much is left oweing and that all further payments would be sent through certified mail. She would not mail me anything. She began to yell at me and talk over me. She informed me to never call her agency again unless my lawyer contacted them. She referred to me as a low life that had been sitting on this debt for more than 2 years. She keep referring to me as 'people like you'; stereotyping me. She then hung up. I called back only to get a Mary person that told me Ms. Lee would not accept my calls anymore. I asked her to relay the message that I wanted something in writing and she placed me on hold when a Ms. Banks answered and began yelling at me and telling me not to call anymore to have my attorney call.

Misty, This is exactly why you NEVER call, or speak to ANY debt collector on the phone! Furthermore, it is ILLEGAL for any collector to threaten you with prosecution, etc. They cannot do this. There is no debtor's jail. It is not criminal to owe money, or even not to pay it. There is no such law in KY, or anywhere else in the United States. These lowlife knew there was absolutely nothing they could do to you, and that is why they resorted to harassment and intimidation tactics. These are crackheads and lowlife. STAY OFF THE PHONE!! And, don't pay these crackheads anything! Send them a CEASE COMMUNICATIONS request as per your rights under the FDCPA. Send this by certified mail, return reciept requested and be sure to put the certified# on the letter itself. Keep a copy for your records. This is very important as it proves exactly what you sent. Now, when they violate your legal request, you sue them as provided for in the FDCPA.
