I purchased an Acer Aspire 5610Z from Walmart in Heber Springs Arkansas on September 7th 2007. (TC#2366 0328 4984 5270 5234 9)

Two weeks after purchase The screen started to black out. First it was momentarily. Then it started staying off for 3-5 seconds. I purchased a microphone head set, so I could make full use of the voice recondition features, it wouldn't record. I thought it was the microphone. I went through several brands of microphones,thinking they were just not compatible. Finally I called Acer and explained the problems. It was determined that the microphone jack and the screen needed repair. I needed to send it to the repair center in Temple Texas, it cost me $29.15 (See attached copy of receipt). This machine was new. I'm a professional driver. I was on the road when it arrived, I did not get home to check out the repairs for 10 days after.

When I did open it and begin to use it I found that the screen problem had not been fixed. The microphone jack works. However the computer now hears itself and produces feedback noises unless the speakers are muted and it no longer has bluetooth capabilities. The repair work was so sloppily done that the cover in the bottom was put back on crooked.

It will cost me another $29.15 in shipping charges to get warranty repairs that shouldn't even be happening this soon after purchasing. Then it's just a hope that the notebook will actually be fixed since it was not fixed the first time.

I requested a refund from Acer. It is not Acer's policy to exchange or refund for defective products.

Walmart refuses to do anything since their policy on the receipt states that all computers can be returned or exchanged with receipt with in 15 days.

Because of the policy statement on the receipt Discover is not able to dispute the charge.

So here I am stuck with a $722.88 laptop that cannot and has not performed as it was advertised. Nor do i feel it's right that I should have to pay shipping charges for an item under warranty and malfunctioning within the first few weeks. Had the unit been properly manufactured, none of this would be happening.

I want a full refund from Acer including the $29.15 shipping charge that was wasted for a total amount due to me of $752.03

I tried to solve this through other avenues but it was very time consuming and didn't work. Neither Acer or Walmart will accept responsibility,

You stated you have tried other avenues to resolve your issues . Did you file a complaint with your local Office of Attorney General's consumer affairs ? If not , I'd suggest doing that . It isn't they won't take it for repair on the second attempt , it's that they want to charge you shipping each time for a problem that wasn't correctly repaired that you already paid shipping for . It may take up to 30 days from the time you file a complaint to get a response . You shouldn't have to . In the end you may have to compromise for a refurbished unit of equal value and quality , or better . I had to with a desktop . although not an acer , or bought at walmart . You are now dealing with the warranty , and they'll play hardball , play it harder , with the OAG .
