I am here to tell you the true and correct and complete version of what happened when Amanda Loch ripped me off.

In September of 2005, "jewlz2003" aka Amanda Loch won eight auctions of mine on Ebay. These were all for my daughter's infant clothing, at prices ranging from $0.01 to approximately $1.50 each. In my auctions, it is clearly stated how I charge for shipping, which is: $4.99 for the first item, and $2.99 for each additional item. This is charged this way so that I do not lose out on shipping, and the numerous auction fees, plus that is how I can afford to sell the items for so cheap. I am NOT a dealer or business, and am only liquidating items that my daughter outgrows. Therefore, I am not really in it for the "big money", but merely to clean my house, and make a little on the side while doing so.

Anyhow, at the close of the eighth auction, I sent Ms. Loch an ebay invoice for the eight auctions, plus the discounted shipping. She initially did not respond. I waited a week, and filed a non-paying bidder alert with Ebay for each auction. She then responded, letting me know that she had mailed a "money order". I waited another week. I emailed her to let her know that I still had not gotten payment. She stated that she was late mailing it, and that it was now in fact on the way. I waited yet another week.

Almost one month later, I finally get a personal check for the amount of $41.00 (not a money order), dated October 10, 2005 from Keith P. Holcomb (her boyfriend). I usually don't accept personal checks (only Paypal or money orders), but I figured that I was happy that she had sent payment, even though the check should have been for a few dollars more. Since I had been waiting so long, and am usually really fast at shipping, (check my other feedback), I already had the package ready to be shipped. I went to my bank cashed the check through my account and mailed her package out all in the same trip.

When I got home, I closed the "non-paying bidder" disputes through ebay, and e-mailed her to let her know that I sent the package and closed the disputes, thanking her for her business. She then e-mailed me back that she no longer wanted the package. I told her that I had already cashed the check, and that the package was in the mail. She never responded.

A few more days went by, and I noticed that there was a misc. withdrawl from my bank account for $56.00. The next day, before I could even call my bank, I get something in the mail from my bank. I open it, and to my surprise, it is the check from Keith P. Holcomb Jr. (the one that Amanda Loch sent me stating it was her boyfriend paying), with a huge red stamp across the front stating "ACCOUNT CLOSED". The letter included with the returned/bounced check was from my bank stating that not only had they taken back the $41.00 for the check, but that they also had charged my account $15.00 for returning the check!

I was upset. I had never had this happen to me before, and being an honest ebay seller and buyer, I felt that this was all part of a scheme that she knew that she was ripping me off from the start, by writing me a check on a "closed account".

I contacted her via email to let her know that I had the check returned to me, and to that she stated that she no longer wanted the items, and that she would not pay. After I contacted Ebay to make them aware of the situation, as well as Square Trade, she then started saying that she never received the package, and that is why she "cancelled the check". The check was not cancelled, it was written on a closed account!

Further more, since the initial "non-paying bidder" disputes had previously been closed (when I got payment), I had no way to re-open them to pursue her through Ebay. Ebay did in fact refund me my auction fees for those items, since I DID produce proof that the package was mailed.

All of the auctions were mailed together in one package, thus the "shipping discount". She was very rude to me, and I do admit that I got rather rude back with her, but I am not sure what she is trying to pull. I have since forwarded this information on to a collection firm, which billed her and her so called boyfriend for the amount, and recently got a response back from Amanda stating that her and her boyfriend are both in the process of filing for bankruptsy, and that if I wanted to pursue this matter, she would include me in the bankruptsy, so that she doesn't have to pay it, because they "can not afford to pay".

I think this is a lot of work to run from a lousy $41.00 purchase, but apparently she needed the clothing more than I. I am just sorry that I could not have donated them to her needy cause instead of her costing me shipping, bank fees, auction fees, collection fees, positive feedback percentage, and slandering my name like this on the internet. I feel real bad for her. I have chalked this up to experience now. I, unfortunately do not have the same trust in buyers that I once had. I now wait for payment to clear, or I only accept instant payment, so that I don't have to deal with scammers like this anymore in the future.

I know the truth, do you, now?

I would like to take into consideration that you were the first person out of close to 160 E-bay members to leave a negative in my feedback, where as I was not the first with you. You, I, and god know the truth about what happened. I do feel there were many misunderstandings that took place, and we both have different views on who is right or wrong and what actually happened. You maintain your side of the story and I maintain mine. We obviously dont know each other, and obviously dont know the character of the other very well. I just know that we had a transaction that went horribly wrong and we severely butted heads with each other. Some of your facts in the above account arent true at all. If you did mail the package Im sorry for that, because I did not receive it. If I had I think that would have eliminated a lot of the problem and drama, because I wouldnt have been accused of stealing your stuff, and you would have received compensation. I still hold that if you can show me proof that you mailed the items, I will chalk it up to it getting lost in the mail and I will in fact pay you the total amount. Yes, I wish the matter had turned out differently. Yes, I feel bad that we both have such a jaded view of the other. I do apologize for all the drama that has happened over the past few months. This is the only comment I will make on the matter, because Im not willing to continue drawing out the drama with you, as I have expressed to you many times in the past. I hope this can be placed in the past, and life can be moved on for both of us.
