In november of 2005 our mortgage was sold to asc, at that time we were a month behind because my wife was out of work for about 4 months and we had some other financial suprises as well.

When we were notified about the sale of our mortgage it was at the same time our mortgage was due.

We asked who gets the payment our old company or asc.

Asc said wait until the mortgage changes then pay them by dec.15th and they gave us a payment plan.

We mailed them the payment 14 days early because we wanted to get back on track.We later received a call telling us we were late. We told them we sent it early and there response was it took them 2 weeks to process and it was late by the time they got it processed and our repayment plan is cancelled so we need to pay 2 months mortgage now. We complained because it's not our fault it took them over 2 weeks to process.

Finally after a lot of bickering and complaining they said they would put us on a repayment plan again and we were to pay them $3000.00 on feb 15th, we said fine,

Remembering how long it takes asc to process a check we decided to call ahead and make payment by phone,we called them 3 days early on the phone.The so called customer service person said the agreement was broken because it was due on the 2nd.

And so the bickering begins again with probably 50 phone calls made to them. They told us to fax them our financial worksheet and a hardship letter and they would give us a repayment plan.

Every time we called to see if they got the papers they said they hadn't received them.I faxed them to them at least 10 times and even faxed them the fax logs proving they were received,the customer rep said they were having problems because they were really backlogged due to hurricane katrina (even though I feel for the hurricane victims I think this is a lame excuse to pacify me.

Finally they said they got the papers and will set us up on a plan once again, we were to send them another$3000.00 by sat march 24th we just had to fax the papers in again (yeah good luck with that)I started faxing the papers over and over again starting on the 17th figuring I would get something through.

I called on the 23rd because once again about twenty faxes to them all seem to disappear and I was worried. The customer rep. said the fax team was out for the weekend and as soon as the come back on tuesday the will take care of it.

I asked her if I would be penalized since they won't be back untill after the 24th she said no.Guess what they said when I called on monday,Oh I'm sorry but you broke your agreement and now wanted over $4000.00.

After many more calls they said the would try to do a loan modification And bring us back on track we just had to fax them our financials again(I wasn't about to fall for that again)so I sent them overnight they said it would take about 30 to 45 days to process.

When it came back they said we make to much to qualify for a modification. After talking with them over and over they said to send in our financials again.

I did find some expenses I hadn't included in the first one so I put them on the new worksheet,there was about a $700.00 difference between the worksheets. This time it came back rejected because we didn't make enough,They keep finding reasons not to work with us we have tried to give them payments over 50 times and they refuse the money.I wish I had gotten smarter faster because I only have the name of the last 20 who refused our payments.

It really burns me up because I'm a man trying to keep a home for me and my 2 kids and they won't even except money when I try to pay. I think their intention the whole time was to get the house because they have thwarted every attempt I have made to rectify the situation. Things were getting better and going well before asc bought our mortgage now it's been a living hell

We haven't been able to pay when we call them so we gambled and just sent asc $1600.00 on 4/30/06 via western Union. Today is 5/30/2006 and they sent it back in the form of a check. Does this sound like a company trying to resolve the matter? Does anyone know what can be done here I need some tools to help me here. Oh and yes I made a copy of the check so I have it documented.

After all the calls and attemps to pay they have put us in forclosure, during the whole ordeal I can't count how many times we have been hung up on while trying to rectify our situation. The customer service is anything but service. Everytime we have set a date to pay they find a way to drag us to the next day so they can break our agreement.You have to send in paperwork before the payment and the paperwork just mysteriously disappears until the day after the payment is due. If you have mortgage with this company and life has put you behind for one reason or another overnight everything to them! DO NOT FAX they will use that against you.
