My brother had a stroke and his second bypass surgery 4 months ago. Americredit told him no problem about the payments and don't worry. They called him last week and asked about him being able to pay $153.00 fee to keep the account from going into default. He agreed, signed the papers and mailed Ostal M.O. to them. Last night, chicken sh** repo idiot came. When my brother came out of the house, the guy never said a word, but hit my brother twice and knocked him to the ground then kicked him. Left with the car. My brother's neighbor found my brother in the bushes beside his driveway at approx.6am this morning. The neighbors called police and then me.

I immediately drove down from Virginia. Police said, "nothing we can do!" Police said, "it was a repo and my brother interfered"! ??? My brother has portable oxygen bottle with him and is using a cane! He never had time to open his mouth before the coward nailed him! So now, Americredit has no idea of who repo'd the car!!

I have spoken with 6 people since 8am this morning at americredit and nobody knows the repo people??!! I expect they'll figure it out later today. We are sitting here waiting for the Attorney to get here.

I just had to let this be known! I ran across this site while trying to find the "illusive" americredit numbers.

The Paramedics decided my brother was only bruised and scratched a little.

I want to tell everyone this LAW- IF A REPO IDIOT COMES TO YOUR HOUSE, ALL YOU HAVE TO DO IS TELL THEM TO LEAVE AND NO THEY AREN'T GOING TO TAKE THE VEHICLE. THE LAW SAYS TAKING BY FORCE OR AFTER BEING TOLD NO IS A BREACH OF THE PEACE!! "Breach of Peace" is a misdemeaner in EVERY state. Punishable by jail/and/or/fine.

If they put a hand on you, it is a Felony Assault. If they have ANYTHING in their hands, it is FELONY ASSAULT WITH WEAPON. Good Luck to everyone and try to use anyother Financial Int. that you can.

You are right on the law. Repo men are not allowed to use force. It is unconscionable that any police officer would not know that. The repo man is allowed only to sneak up and take the car. If anyone objects, he has to leave, maybe to come back later and try again. If the police were called, and knew what they were doing, they would tell the repo man to leave. That's why repo men don't get the police first, they would be on the customer's side. (The exception is if the finance company got a court order for "replevin", then the police could use force to help the company repo the car. The police would always be called first in this case, since the repo man is still not allowed to assault the customer directly. But this is very rare, since the company would have to have filed a lawsuit and gotten a judgement first.) If your brother's lawyer is any good, he will get the car back with no more payments ever, and some cash out of this too. He needs to round up all the witnesses and go to the local police again, and INSIST that an assault report be taken. Any higher-up in the police department should realize that the first officer made a BIG MISTAKE and the department may be in trouble for it.

I don't know about your neck of the woods, but in Kansas that is known as assault and battery. Get the report from the paramedic. Demand a report from the police department, then contact the District Attorney and advise that your brother wishes to press charges. Repo or not, assaulting your brother is against the law. If the repo person believed they were being interefered with, they should have contacted the police and had them on site. On the flip side, I would get my brother in to see his regular doctor ASAP just to make sure there are no further injuries.
