I filed a chapter seven bankruptcy earier this year and my car was on it. My lawyer has called Arcadia a couple times to have them pick it up. They said they would. I called him and I told him they haven't came for it. He couldn't believe it. He had me call them to see what they would say to me.

I contacted them today and they told me they are not going to pick it up at this time. I asked them what do they mean by "at this time". She said they still have an interest in the car and they can offer me a settlement amount if I want the title for the car. I told her the point of me filing bankruptcy was I couldn't afford it so how can I afford a settlement. She just said, "well if in the future you decide you want it, feel free to call us" What is that? I haven't drove this car in a long time. Technically its not mine anymore. The registration and inspection is due by the end of the month.

Soon it can be ticketed by the police and towed by the township What do I do? If it gets towed and ticketed will I be responsible? I called my lawyer back and he is going to call me on Monday to let me know what we are going to do. He told me they can't do what they did and he's never heard of a creditor that wouldn't pick up the car. He said he'll call them again. I was thinking of just dropping the car off at the dealer. But that would backfire on me. It's not their fault. Its Arcadia's.

They've decided that they won't be able to sell the car for what it would cost them to pick it up and fill out the paperwork. So they're entertaining the idea of a payment from you, because with the car included in bankruptcy there's no way they can collect any money from you now. Remember they're getting zero as it stands now, so even a few hundred dollars should be accepted as a settlement. Since you have a couple of cars now find a friend who could use a cheap car, possibly a really cheap car, and see how little Arcadia will settle for. Or you should be able to re-register the car for yourself, the DMV will still have Arcadia on the title but it's not DMV's job to care if you're making payments or not. If it does get repossessed, the most you'd lose would be the registration fee. If it does get ticketed and towed the township will levy those fees on you. So don't let that happen.

Excuse me? I am hardly a bum. I was laid off from my great paying job. I am currently collecting unemployment and I attend the Art Institute of Philadelphia full time. (5 classes a week, 4 hours per class) I am starting over and I cannot and will not fork over a couple grand to get a car that was discharged in bankruptcy. My fiance and I have a apt. together. He has a new car himself. I brought a reliable Jeep Cherokee for only $500 from a helpful friend. Its in excellent condition. I start a p/t job in two weeks. Arcadia was not trying to help me before I filed. I called them months ago and tried to set up some kind of arrangement to get back on track and they kicked and screamed about coming to get the car. I always paid on time in the past and was a couple weeks late at the time. They are crazy. Now that I filed, they see how much money they are going to lose from all the interest they charged me. They were supposed to pick this car up a long time ago and now all of a sudden they want to help. Whatever.

Sorry for being negative but why are you complaining? Arcadia Financial is just trying to help you...In todays world if you don't have a vehicle people look at you like your a bum. They gave you an opportunity to continue to get to work and to pay. Why are you or your Attorney upset?
