In mid-August this year I got a message from a Michael Blackwood. He said that I had to call him back within 20 minutes in reference to a pending case against me. He left 1-888-288-3114 ex 116 as his contact number, but my caller id showed 716-543-9443. i called him back and he said he was an internet investigator working with an attorney and a company  called   Asset Recovery Group in Buffalo, NY.



He said he had been trying to locate me to collect on an old payday loan from 2006. H e also said that he had been in contact with my grandmother trying to locate me. I had never heard from this man until that day. I did have a loan out in 2006, but to the best of my knowledge it was paid off. He said that i could avoid a civil suit and charges of internet fraud if i settled this account today for $1600.00. He said he could set up a payment plan of $400 dollars a month if i would give him my credit card number or bank info. He also said that i would be receiving some documents in the mail after i set up the payments. I gave my info because i thought it might be possible that i owed this money. i am no longer with the bank i had in 2006, so i thought there might have been a screw-up after i closed that account.



The first payment was supposed to come out of my account on Aug. 31. I had not received my documents by this time, and this did not sit well. I started to ask questions that i should have asked in the first place. Why would a payday loan company need to locate me when i gave them my address and phone number to get the loan? i have not moved or changed my phone number for almost four years. Why did this guy call my grandmother before trying to contact me?




 The 31st of August came and went, but they did not take out their payment. they finally tried on Sept 8, but the bank returned it for NSF. By this time, I had done some digging and discovered a wealth of information on this so-called collection agency and others like it in the Buffalo area. I put in a stop payment order with the bank and changed my account.




 The bank told me i had to try to contact the company to notify them of the stop payment. I tried the number Mr. Blackwood gave me and it went to the voice mail of an Allen Stein with Fidelis. I then tried the number that came up on my called id, and it went to the same guy. I left a message on his voice mail about the stop payment and that i knew it was a scam. i never left my phone number, but the guy called back and left me a message saying he had no idea what i was talking about.




 Afew days ago, Michael Blackwood called and left a message saying that my payment was returned on Sept. 15. I know it was returned on the 8th. i have the note from the bank. He said i had until 2pm the next day to contact him or an attorney named Mr. Carrey would proceed with my case. He left a different phone number than he had before. This time it was 1-877-263-1580 ex 114. I never called back.




 I have read many reports about such things happening. Afew of them make mention of a Frank Falzone Law office that is associated with Asset Recovery Group and several other collection agencies. Apparently he is being investigated too. I just wanted to know if Asset Recovery Group is also Assest Acceptance and if anyone else has heard of this Fidelis company.
 i have filed a report with the FBI and the FTC about all this.

I received a phone call yesterday about an old HSBC Account from 2006. The guy, Mr. Hughes, was so rude and stated, "I did not come to work to be talked to any kind of way". When I asked for documentation of the debt, he refused. When I asked to speak to a supervisor, he refused and hung up. Five minutes later, someone from CA called me saying he was the Director...Very rude. I asked for payment arrangements, he told me he was not in the business of lending to people. I hung up on them and told them to do what they had to do but I was not giving out any information over the phone without debt validation. Then they called and left a voicemail that they were asked to verify an address and ended the call with, "Good luck with this". Are you kidding me?  I have filed a complaint with the Federal Trade Commision and sent a cease and desist letter to them as well.

I contacted HSCB this morning and they stated that the debt was given to another collection agency with a different amount of 292.00 as opposed to the 731.56 they were trying to collect. They also said I was in the clear.

What a bunch of losers...They must be stopped...

Everyone review the Fair Debt Collection Act..Below are some snippets of said act:

The Fair Debt Collection Practices Act (FDCPA), 15 U.S.C.  1692 et seq., is a United States statute added in 1978 as Title VIII of the Consumer Credit Protection Act. Its purposes are to eliminate abusive practices in the collection of consumer debts, to promote fair debt collection, and to provide consumers with an avenue for disputing and obtaining validation of debt information in order to ensure the information's accuracy.[1] The Act creates guidelines under which debt collectors may conduct business, defines rights of consumers involved with debt collectors, and prescribes penalties and remedies for violations of the Act. It is sometimes used in conjunction with the Fair Credit Reporting.

This law prohibits the following:

Misrepresentation or deceit: misrepresenting the debt or using deception to collect the debt, including a debt collector's misrepresentation that he or she is an attorney or law enforcement officer[14]

Threatening arrest or legal action that is either not permitted or not actually contemplated

Give the name and address of the original creditor (company to which the debt was originally payable) upon the consumer's written request made within 30 days of receipt of the 1692g notice;[13]
Notify the consumer of their right to dispute the debt (Section 805), in part or in full, with the debt collector. The 30-day "1692g" notice is required to be sent by debt collectors within five days of the initial communication with the consumer, though in 2006 the definition of "initial communication" was amended to exclude "a formal pleading in a civil action" for purposes of triggering the 1692g notice,[24] complicating the matter where the debt collector is an attorney or law firm. The consumer's receipt of this notice starts the clock running on the 30-day right to demand verification of the debt from the debt collector.[13]
Provide verification of the debt[25] If a consumer sends a written dispute or request for verification within 30 days of receiving the 1692g notice, then the debt collector must either mail the consumer the requested verification information or cease collection efforts altogether. Such asserted disputes must also be reported by the creditor to any credit bureau that reports the debt. Consumers may still dispute a debt verbally or after the thirty-day period has elapsed, but doing so waives the right to compel the debt collector to produce verification of the debt. Verification should include at a minimum the amount owed and the name and address of the original creditor

Im prepared to see them go down to the fullest extent of the law....

I would imform this caller that you know this is a scam and if he calls again that he will be reported for fraud I would also suggest changiing your # and have it unpublished .I would tell the phone company that you do not want the # given out .I would also your bank know about this and give them this scums 411 . I read were 1 did that here in Rip off report the bank called this scammer and told them that if they accessed the account charges would be brought up against them. If anybody ever tried to scam me I would cuss them out like a sailor. To be on the safe side I would still close my bank account and reopen it with new #s if they call and ask for the  new account # I would refuse to give it and let them know that they have been reported to the FBI and hang up on them

i would block his number, but it keeps changing. almost every time he has called a different number has come up on my caller id. the last time it came up as a number in a town about 40 miles from me. i called it back just to be sure, and that Allan Stein with Fidelis answered. Mr. Blackwood told me before that Allan Stein is his supervisor. these people must think i'm really stupid.

since i originally posted this report, Michael Blackwood has called me two more times. The first time he left this message telling methat they are a legit company, and i'm just trying to get out of paying my debt. naturally, he would try to convince me they are for real. he also tried to tell me i have no right to say they are a bad company because i must be a bad person since i have a myspace page, and i used to sell Pure Romance products as a sideline. if having a myspage make ME a bad person then millions of other people are just as bad as me. LOL. I don't even sell Pure Romance anymore, but apparently, trying to make a little extra cash makes me a loser.
 The next call came yesterday, and this joker tried to tell me that if i didn't buy a ringback tone for my cell phone, maybe i could afford to pay my bills. OMG my ringback tone cost me about a dollar! that somehow compares to the $400 a month payments this idiot wanted. then he said that i probably spent the money on fun stuff. if i had an extra 400 bucks to piss away, i would use it for practical things that my famil needs. he then said that i put the stop payment on it because i didn't have the money in my account. umm.. i did that because i don't trust these people. even if i did have the money, i still would have done that. what a jerk! he also said if i didn't respond immediately he and this lawyer, Mark Carrey, would come here and take legal action against me! oh please! as if a lawyer would come all the way from New York to Montana for something like this. it would cost them more to get here and back than they could ever get from me.

I would close my bank account and reopen it with new#s  I would also imform my bank that this person is trying to scam me and give the bank his name and  # I would have the bank imform him that if he tries to access your account that fraudualnt charges will be brought up against him and he will face prison time. If he calls and asks for the new account # refuse to give it. I would also tell him Go f---yourself
