Not long after "Ray" had his run in with (Boston) Basement technologies, it was found that a number of employess of that same company filed a series of charges with the IRS and the Commonwealth of Massachusettes.

It turns out that Mr James Pratt (owner of the company) had NOT been paying any taxes on the wages he was paying many of the employees, and even worse, was listing most of his employees as "sub-contractors".

In the course of researching these matter through the Massachusettes Atty. General's offices, it was found that Mr Pratt had previously been chastised by the IRS for the exact actions previously, but he just didn't care. He had also been warned about failing to maintain proper workers compensation on his sales staff and installation crews. But did he ever follow the "rules" and straighten things out? Obviously NOT.

In 2005 a group of employees file charges that Mr Pratt had been systematically stealing from their paychecks by claiming 'back charges' against them to recover money that he was losing as the result of poor product quality failures, and even worse quality of installation.

Over the course of about 2 years, and as the result of hundreds of hours of investigation by the Mass. Atty. General's office, it was proven that Mr Pratt had in fact been taking the money, or in some cases just refusing to pay at all.

In the end, Mr Pratt had to pay out more than $32,000.00 and back wages and payments, but that is not the end of it.

Although the final payment was accepted in June of 2008, the case is still continuing as it appears even more issue have surfaced which are yet to come to a legal "offering" at the bench.

 Care to enlighten the world on losing your state license and....WHY?  If you people don`t first--identify/determine each and every homeowners actual-problem(s) correctly and honestly sir, your full O crap,and deserve to lose much more than your license .....got that? Tired of inside bozo`s telling everyone on earth their problems are under the stupid floor and everybody has to have your twinkie inside system installed, thats Noooooonsense, thats MISREPRESENTING MOST homeowners actual-existing-problems,yep!!! In fact, incompetence and-or lying about any homeownrs true-problem and ONLY solution to that problem for SELF-gain is fraud sir, uh huh.

Although the Ma. AG case on this matter was resolved in June of 2008, the group of  employees is still looking to pursue additional statutory damage recoveries against Pratt and the company.  They are presently seeking an attorney who will work with them to make final claim, but with a 3 years statute of limitations on the actions, time is rapidly running out. 

If anyone knows of an attorney, please post here so that we can recover the rest of what this unscrupulous company and individual owner have cost us.

Rip Off Report Untrue and Full of Inaccuracies!

After reviewing the comments and accusations made in the report submitted on 9/11/08 by a gentleman from Newport, RI, we are amazed at the factual inaccuracies in the majority of the information. The gentleman states that Ray had a run-in with Boston Basement Technologies. After long investigation, it was determined that Boston Basement Technologies never had anyone in our employ with the name, Ray. We have never had any charges filed with the Internal Revenue Service or have had any cause for any charges to be levied against us by the Internal Revenue Service. The Internal Revenue Service has never chastised us and we pay our taxes on time each year. Boston Basement Technologies and Basement Technologies tax payments are made on a quarterly basis and are checked by a Certified Public Accountant and are finely tuned by the in-house controller. These claims in this document are simply false.

Five former sales representatives filed a complaint with the Attorney Generals Office in Massachusetts regarding sales commissions. The claims were based on the fact that the salesmen claimed they were not paid their full commissions. The facts are that the salesmen sold jobs that could not be installed or misinformation was given to the office without pictures so that the systems could be properly installed. Basement Technologies provides each salesperson with paperwork prior to employment, detailing that they are fully responsible for making sure that the job is proceeding properly. These five salesmen did not submit all the required paperwork with proposals, pictures of the jobs and the follow-up on the customers of the jobs. Their pay commission was based on the performance of all steps outlined in order to achieve full commission. These salesmen were negligent; they did not bring in the proper information to the office and, therefore, were not paid the full commission. It was a point of view that the company had versus the salesmen. The salesmen were never stolen from or treated in an unfair manner. They signed documents agreeing to perform certain tasks and when they were let go for non-performance, they became angry and came after Boston Basement Technologies with the Attorney General.

All employees of Boston Basement Technologies and Basement Technologies are registered as employees. We do not use sub-contractors. The settlement with the Attorney General was for so-called unpaid commissions only. We settled this case because we did not want to litigate it further. Settling the case was far more cost-effective for the company than to go through a legal dispute with the State and the salesmen. The salesmen were represented for free and the companys legal costs would have exceeded $100,000.00 to defend Boston Basement Technologies stance. It was a business decision to settle the matter and pay the salesmen. The case was closed and there is an agreement in settlement with the Attorney Generals Office.

Summing up, the information given to the Rip Off Report was inaccurate and tainted to give the impression that our company cheats its employees, is a company that defrauds the Internal Revenue Service and is viewed as a criminal with the Attorney General. This is not true. Boston Basement Technologies has been in business close to 25 years and follows up on each and every job that it performs in a professional manner. We have thousands of satisfied customers and close to 100 employees at all times and have over 100 dealers internationally that follow the same procedures as Basement Technologies in Boston. The insinuation that our company is under-handed is a slap in the face and Carl is welcome to call the owner, James Pratt, at any time to discuss these matters.

The information relayed in this report is completely based on myth and anyone who has questions in reference to this may call the office in Brockton, MA. Our reputation stands for itself. We are an upstanding member of the Better Business Bureau and a member of the Chamber of Commerce. We have thousands of satisfied customers throughout the world and are a pioneer in the basement waterproofing industry. We develop our own products and take great pride in our companys ethics and integrity. We need to set the record straight!
