I recently purchased a DVD at Best Buy in Utica, Michigan. Brought it home, took off the shrink wrap.

I noticed there were not any security seals on it & the case looked "used", I.E. had some scratches on it. I opened the case, and examined the DVD Disc, noticed it had:

1) Several Small Scratches

2) Dust

3) A "Water" Spot (small circular area of "hardened" dust as if a drop of water or sweat had hit it)

4) The icing on the cake ... A Fingerprint on the edge of the disk that certainly was not mine.

I have purchased hundreds of DVD's (Only about 2 dozen of which I bought at Best Buy) and have never encountered this before.

I took it back to the store to get it replaced with a new one, and explained the situation. The clerk told me it was "illegal" to repackage a DVD for resale, and that it probably happened at the factory.

Seemed to me to be a blanket but absurd response, because DVDs are so cheap to produce that there would be no reason for repackaging of DVD's at the factory. According to the clerk then, someone in the Best Buy chain illegally repackaged a used DVD.

I did, however, get the DVD replaced with a NEW one off the shelf with no hassle. I furthur advise all people purchasing DVD's, CD's, and computer games at Best Buy to examine the pakage and ensure the Security tape is in place before buying.

Ohio's Attorney General filed a suit against Best Buy a few weeks ago for unacceptable business practices. The suit claims that Best Buy has failed to honor rebates, refunds, exchanges, and service contracts. Also that they repackage used or returned items and sell them as new. So it looks as though your suspicions about your DVD were correct, Larry. If this has happened in Ohio it has to be going on nationwide.
