So Daniel's complaint has nothing to do with Mark's computer business and everything to do with a car he tried to buy on craigslist. The only mention of the business was because Daniel went to Brainwave to do what? Deliver the first payment? Well in regards to Daniel's complaint, and I am speaking from the stance of working in the field of law, it's pretty tantamount to slander when you complain about something that doesn't have anything to do with the topic of the complain if that makes sense. Just for the record, I use Brainwave for my computer needs; I've brought Mark parts I've bought online, and he'll put your computer together wonderfully. I've also bought parts from him for repair jobs I've had him do. Currently he does all the computer work for me, my wife, my mother, my sister, and anyone else that wants a reliable and trustworthy computer repair shop.

I also found Mark @Brainwave PC not long after his business opened. I trusted him to be the repair guy I used exclusively until I decided to trade in my dinosaur laptop and 2 weeks ago, purchased one from Brainwave. I've witnessed his interaction with his daughter and members of the congregation of the Church, Mark and his family attends. I've also been there when other customers have been in the business as well as overhearing phone calls from other customers. At no time did I get the impression there were any scams going on. The rates are reasonable and the work performed is excellent. I've never felt taken advantage of and will continue referring other people for computer repair. This initial post sounds like sour grapes to me.
Before you sign any contract, you should read it. You can negotiate any terms of the contract you are not in agreement with, PRIOR to signing. So many people sign without reading. I imagine anyone riding a bike and working hard at a minimum wage job would jump at a "deal" to buy a car with installments. Sounds like this was a "no money down" deal. When payments could not be paid in full and on time, verbal modification of a written contract were made. I'd say that was a pretty sweet deal and very kind of Mark to try to work this out.
I am glad Daniel decided to post this report. His testimony is the most damning. Clearly Daniel was in the wrong, but I doubt anyone can help him see that.

Well you knew i tried my best to make payments. Imagine riding bike back and forth every day to a fast food restaurant job in the cold and in the rain. Everyday being tired and getting soak and wet to make payments to you. I suffered through this only to get nothing and you've done this to other people. You should be ashamed of yourself Mark Gibbs. Your a heartless human being. You knew I have a daughter and the court date was right before Christmas. God. I hope you buy a new heart with that money because that is something you really need. You are so pathetic.
After i was making regular payments, child support kicked in and you told me it was alright and that you would work with me. But when we sat down in the Mediation Hearing you said it wasn't in the contract. Yea it wasn't so ok you weaseled yourself out of that one didn't you? Sorry to say but you've made alot of people mad and i hope that carma comes back on you. I feel sorry for any customers that come into your business. I hope that they realize how much of a scumbag you are. At least you could have given some of the money back.

So i guess not answering your calls or returning my messages is considered breaking a contract. Also saying i'm a child molester! Grow up man. Really is this really how a business person is suppose to act like? This isn't high school. So people i honestly wouldn't trust him. If you have kids, don't trust him, if you work hard for your money (i know alot of you guys do) and want it to be from an honest person, don't trust him. Go somewhere else. There are alot of computer companies around with good records. Unless he has a change of heart. I'll honestly tell you......

First off, I would like to state that this was a transaction for my 1998 Honda Prelude I sold to Daniel Baxter, and has absolutely nothing to do with my business.
Daniel violated a payment agreement I had setup for him on a vehicle, did not contact me for two months, and then started harassing me by calling me 20+ times in a row. This is why I called the police and told him not to contact me anymore.
Yes there was a small claims lawsuit against me and my business, and I won. He lost the lawsuit because I did nothing unlawful, and absolutely did not "scam" him. The comment about the Sheriffs office is completely false, he was unable to provide any evidence in court to prove any of this, while I provided phone records, payment logs, etc to prove I was in the right, and the judge agreed.

I am sorry it had to come down to this. I was really looking forward to the day I could hand over the keys and we could both be happy. However, your lack of payments, late payments, and not even paying the right amounts when you were supposed to is the reason this has happened.
The FIRST month, you were short $100 on your payment. The next month you were 2 weeks late. The next month was fine. After that you didn't finish making another payment for THREE months. When I talked to you about it, you assured me you would be caught up on payments. I waited 60 days for you AFTER that and you didn't call, didn't text, and never came by my shop. In the contract we both agreed to, after 30 days of being LATE the car and payments are forfeited. I gave you 5 months.
I wish you the best in life and hopefully you can accept the consequences and move on.

I was reading and I have just a few questions to clarify things better. You said, "When i would make my payments i would go to his Computer repair business (Brainwave PC) in Aloha, OR." You also said, "So, after about five months later around June of 2012 after making payments (aprox. $3,100 total) he wouldn't answer my phone calls or return any of my messages that i had left. After calling repeatly he finally answers and says that it isn't his responsibility for him to make sure i make my payments."
Instead of calling him why not just show up at his business to make the payments? He runs a business so I'm assuming he has business hours that he is suppose to be there. That last comment I quoted you on makes it sound like he was the one contacting you to make sure you make the payments and he was becoming tired of it.
Please clarify as it's kind of confusing!

The guy who posted this bogus ripoff report is a child molester and a fraud.
See for yourself, arrested in Oregon for statutory rape. This loser lost his job and is just trying to get out of a breached contract. This guy did the same thing with me about a motorcycle 2 years ago.

Not sure what Daniel is thinking, but this isn't an auto dealer. Brainwave PC is a computer repair store and this is a personal matter has nothing to do with that business.
I have personally known Mark @ brainwave since he opened and as a customer of his I can vouch for his great work and honesty.
I spoke to Mark about this and I looked at the evidence for myself and Daniel violated a contract by not paying for 3 months and therefore lost the car and the payments. Sorry Daniel maybe you should keep your end of the contract and this won't happen to you!
