I was emailed last night by a person who called Capital First to cancel their "membership" and informed the rep that she was disputing the charges with her bank and having the debit reversed.

The rep informed her that reversing the debit on the account would be a criminal offense like issuing a bad check and Capital First could file a criminal complaint using the taped conversation during the enrollment process to prove it WAS an authorized debit.

Does anyone know about the accuracy of this statement??

I hope they haven't figured out a way to legally keep our money!

Tell your friend not to worry. There is zero likelihood that Capital First ever would charge anybody. Capital First is a group of criminals, hiding in Canada. A multiheaded dragon. When authorities cut one head, 10 more grows. Changing names, poboxes, calling centers in every 3-4 month. They want justice? Suing their own victims? Have you/your friend tried to find any corporate information about Capital First? Hardly will find anything else than a pobox. The "representatives" are a couple of dozens freshly hired low-paid workers. They use fake names, fake, very uninventive id numbers as 789456. They do not tape anything. It would be very bad for them to create proof against their own "company". About the reversed charges. If you authorize a credit card or checking account withdrawal for a service for a merchandise, and you do not get the service merchandise you have the right for the chargeback. The other party broke the contract. Capital First never ever provided any service to anybody, so it would be very interesting to see the base of any "criminal complaint". Very simply the ignorant "representative" were harrassing your friend. You do not have to take my words. I am not a lawyer only a volunteer, who see many similar scams. Read other posts about Capital First, you will see more clearly this scam. If your friend has any doubt, she/he may call for more information the Federal Trade Commission's Consumer Response Center: 1-877-FTC-HELP.
