Back in March of 2004 my husband and I where looking for a Lee's brand carpet because we liked the warranty (25 year stain and wear) it has so we were checking around at different carpet places to see if they carried it and get a price. My husband stopped at Carpet Brokers of Bismarck and they told him that they would check to see if their supplier could get the carpet we wanted. My husband was vary explicated that we wanted a Lee's carpet. Jeff Conlon the owner told My husband that he could get that carpet and what it would cost. The price seemed to be a good deal so he order the carpet.

When the carpet layer came with the carpet to install it my husband seen that it didn't have the same backing on it as we had seen on a Lee's sample. My husband knew that this wasn't a lee's carpet and called Mr. Conlon and told him this. Mr. Conlon said he would need to call his supplier and get back to my husband less than a minute late the phone rang it was Mr. Conlon he agreed that this wasn't Lee's carpet and would still give us the same warranty as a Lee's. My husband told him no thanks that who knows where he would be in 25 years.

Mr. Conlon did give us a refund on the carpet but we had to wait a couple of weeks for it. We took Carpet Broker to small claims court and won a judgment against them for what it cost us to get a real Lee's carpet and for all the pain and suffering we had to go though. Our Judgement is for $1,579.34 plus 12% interest and fees. To date Carpet Brokers owe us over $2100.00. We have been fight to collect our judgement for two years. During that time

Mr. Conlon has lied under oath and has hide assets from us. Just when we thought that we were going to finally get our money The Conlon's filed for chapter 7 bankruptcy, the bankruptcy has been granted. Which means the Conlon's do not have to pay us anything.

I am writing this so others don't have to go through what I did. Please don't buy from Carpet Brokers They are Thief's

in her complaint, rosemary states that they were refunded all of their money for the carpet in question.
rosemary s husband had contacted me and asked if i could get the carpet they were looking for. i then contacted an broker in florida who deals with all brands of carpet. he told me the one i had asked for was available. i then gave mr. berger a price on the carpet and he requested i order it for him.

when the carpet arrived, the installer picked it up at the shipping company and took it to the berger home to install. when the product was unwrapped mr. berger noticed it,did not have the same backing as the sample he had shown me at time of order. mr berger then contacted me and i called my supplier. my supplier told me it was the same carpet but with a different backing. i let mr berger know what i was told, and he said he did not want the carpet. i told him i would refund all of his money as soon as i received a refund from my supplier. the berger s received every penny back that they had paid me.

i was shocked when  received a summons to appear in small claims court regarding this matter. i was sued for the difference of what the bergers had to pay another dealer for the carpet they wanted, and the price i had given them on the carpet. we appeared in court and the referee ruled in their favor. i was astounded to say the least. the referee is no longer in that position, and i was told that he lost his position due to questionable rulings. unfortunately, small claims decisions are not able to be appealed. rosemary claims i perjured myself and declared bankruptcy to avoid paying them their $1500.00. there were no perjury charges filed against me and i certainly would not have filed bankruptcy over such a small amount. 

i would recommend to rosemary that she recant the claim that i perjured myself, since it is slanderous and untrue. if anyone wants to check on my business dealings you will not find anything negative other than this complaint. to think that you deserve more than your money back when returning a product to a store is ridiculous, and i feel most everyone would agree. rosemary was clearly trying to take advantage and in my opinion is a "nut case."
