According to the contract I have with CashNetUSA, they were to deposit funds into my account on August 4. The contract does state that they are not liable for late deposits for events beyond their control such as bank errors, holidays, etc. and they also cite your being late in providing additional information such as paystubs and that is all they list. I applied and then immeidately via fax and email sent the required paystubs. AFter not hearing from them I resubmitted the paystubs with another email. I then received a letter indicating the deposit would take place on August 4. On August 4, no deposit and several of my checks hit the account creating $140 in overdraft fees. I then received an email early morning Aug 5 stating that they would be late depositing the funds. By then, the funds were in the account, but I still had the overdrafts, the whole reason for taking out the loan in the first place was to avoid these overdrafts. Now I have the OD fees as well as the loan fees for nothing.

I contacted them and they refuse to honor the contract stating that the loan is not valid until the funds are deposited into the account. I know that there is a recission clause in the contract, but you only have until the time the funds are in the account. By the time I got the email that it was late, the funds were there, so recissioin time was over. Anyway, they failed to meet their contractual obligations by depositing by August 4 and are refusing to reimburse or credit me the $140 in overdraft fees they caused.

You state that you knew your account was going to be overdrawn that's why you went to get a payday loan in the first place.  And you are mad because they won't reimbures you for the $140 in overdraft fees.  Why should they?  They didn't write the checks that resulted in the overdraft fees, you did.  You should be mad at yourself not them.  They did nothing wrong.  Their terms clearly state that they don't guarantee that your fees will be deposited on the next day.  You are the only one who is responsible for your bank account.  Don't write the checks and you won't have the overdraft fees.
