Hi Maura, My name is Priscilla and I am also with Centex having similar problems with them as you. First, let me tell you that the people you are dealing with are collectors only. There are many VPs in Centex as I have spoken to many of them all who claim to be the supervisor, boss, VP, etc. You will get no where with them as they are only trying to make money off you by making your payments late on purpose just to charge you a fee. These people evidently never heard of the Fairbanks Case or other loan servicing cases such as Ocwen, Litton, etc. All these servicers do is make your payment late to charge late fees. That's how they make their money. The first thing you should do is do not speak with them at all, as you will just get upset at what they are saying/doing. Write to your Attorney General's office explaining what you have in this report and file a consumer complaint against Centex. The are violating the Fair Debt Collection Act by treating you this way and I'm sure they are violating many other acts and laws. As you can see, you are not alone, there are others like us in the same predicament. If Centex is unwilling to negotiate with you, find out what your laws are in your state regarding debt collection and see if they are adhering to those laws and if not, write Centex a letter telling them what they are violating. The best thing from here on in is to write letters to Centex creating a paper trail because they will lie to you on the phone and then later say they never had that conversation with you. As far as the tapes are concerned, there is none. They are not taping your conversation. In some states, it is illegal to tape record conversations. Massachusetts is one of them. The next thing you need to do after you contact your AG's office, write to the Federal Trade Commission, go to their website and you will find their address. Also, write to the Better Business Bureau in Dallas, TX as a bunch of us have already done that and they will keep these types of complaints on Centex for 3 years. The contact name at the BBB is Don Morris. Website is 222.dallas.bbb.org. Also, write a letter to the Chairman of the Board at Centex in Texas. It use to be Laurence Hirsch, but there has been a change in command there and now there is someone else, and I forget his name. Their website has that information. Also, see if you can have someone in the mortgage industry who you can trust look at your loan documents to see if there are any illegal charges on there. You should also go the HUD website and look at RESPA information and possibly do a Qualified Written Request to get copies of your account and how they are applying your money. This you are entitled to by law. I am not an attorney, just a consumer who has been fighting with Centex for a year and one half. There are a group of us and we all visit MSFraud.org and Contifairbankssucks.org sites and post there. Visit us there and you can get more answers to your questions and problems. Know that Centex will lie to you to get your money. They are violating the law when they threaten you. Do not let them get away with this and do not let them tell you what is right and what is not. They are wrong!!! All the time. They are also a predator just waiting for you to mess up with your payments in hope that they can foreclose on you. They are in the business of foreclosure and not mortgage lending. I am trying to get the Federal Government and the Attorney General's offices in various states to file suit against them, it's a very slow process. There is one organization in Washington, DC who is looking into that and they are the NCRC (National Community Reinvestment Coalition). They have a consumer rescue fund available to get you out of the horrible loans Centex and others give us. Take care and hopefully this information will help you.
