My husband and I were applying for mortgages on-line, as first time buyers, through Federal Housing Authority (FHA).  My husband received a call from CHRIS CUELLAR (CON MAN).  Somehow CUELLAR found our information and the name of our banking institution from FHA.  

CUELLAR represented himself as our bank, BANK OF THE WEST in Nebraska, and began to correspond with us via email regarding applying for a mortgage.  My husband gave him more of our personal and financial information.  CUELLAR claimed we were pre-approved, but would not put in writing as to how much and for what APR?  I did not understand why CUELLAR was asking for more of our financial information if he was a mortgage representative from BOW.  That's when I told my husband I need to be cc: on all emails and conferenced in on all phone calls.  I contacted our bank.  They informed me, they do not have a CHRIS CUELLAR working anywhere in the company of BANK OF THE WEST in Nebraska.  

I then began to look at CUELLAR's emails to us.  The first shows he worked for BOW.

In later emails, it shows CUELLAR works for GSB Mortgage out of Texas.

SO WHICH IS IT?!!!!

So, I informed CUELLAR that he did not respresent our BOW.  Now, he stated his company is a wholly owned subsidiary of BOW.  I said, "What company are you with?  Because you do not represent BOW?  Who employs you?"  Finally, CUELLAR admitted to working for GSB Mortgage.  I asked, "Then why are you sending emails to us under [email protected]?   Who do you work for?"  He then, began to accuse BOW of not doing what they are supposed to do in offering us a mortgage, offering us a low APR, and the proper method BOW should handle us.  I told CUELLAR, "I have a longstanding relationship with BOW.  Who are you to be advising me on what BOW should offer us regarding a mortgage?  Since, you ran a credit check our question to you is how much are we pre-approved for and what is the APR?"

CUELLAR became angry that I was asking legitimate questions to determine his identity and who does he represent, until he just hung up.

LESSON LEARNED: Do not give information to anyone calling you claiming you applied for a mortgage with their company.  Take their name, number and company name, and do your research.  

(1) Check if the company's website;

(2) contact your bank to check if the company is registered with the FDIC (my bank's mortgage department confirmed this for me);

Bank of the West told us that BM Lending is not registered with the FDIC.

GSB Mortgage, Inc in Texas is registered with the FDIC.

(3) then call the company to verify if the person works there;

(4) call that person's extension to speak with them directly or leave a message so they can call you back.

(5) DO NOT TAKE COLD CALLS.  A cold call is an unsolicited call from someone claiming you gave your information to them.  

Needless to say, after we spoke with CHRIS CUELLAR, told him we found out he did not work for Bank of the West in Nebraska, he emailed us that he was closing out our mortgage application.  CHIRS CUELLAR IS A PHONY.  HE MISREPRESENTS HIMSELF.  HE PRESSURES YOU FOR YOUR INFORMATION AND TO SIGN THIS AND SIGN THAT, BECAUSE HE'S WORKING UNDER A DEADLINE.  DO NOT BELIEVE HIM.

 I just closed on my loan and I did use Chris Cuellar as my loan officer.  The loan did close and the bank I used was GSB Mortgage which is a subsidiary of Bank of the West after I did my own personal investigation.  I saw the post on here about Chris Cuellar but I was referred over to him by my realtor and decided to use him due to his vast knowledge....if it weren't for his expertise in credit knowledge I would have never got my scores up high enough to do the loan so I felt like I owed it to him to do the loan even though I saw the negative post about him.  Now that I have gone through the whole process and closed I can truely say that Chris Cuellar is not a scam artis nor a con artist and that I feel like ripoffreport blog should do a investigation to make sure that the commments on here are not fraudulent themselves.  It took about thirty days to get my loan closed which I went through several other lenders that said they couldn't even get my loan done due to my scores being too low and that is when I decided to listen to my realtor and use Chris.  If it weren't for him and his team then I would still be renting and would not have a place that I call my own.  I do feel bad for Chris because it has been brought to my attention he got let go from GSB mortgage recently due to the comments on here and I thought the least I could do is set the record straight and let them know he is a good loan officer and not only that but my realtor has been using him for over a year and she had nothing but good things to say about him.  I just feel sorry for the people that lied and stated all the bad things that are not true and hopefully they will make this right by Chris since he is a good guy.

when i started to by a house .mr. cuellar had tryed to get me a a gi loan but he kept goin until he and his co worker did get a loan for me. he was straight from the begining to end  honest. and careing if i was to get a new house mortgage again. i would deviedly go to mr . cueller and the co. he works for.

Unfortunately, there has been a misunderstanding with the client that completed this report. I am the President of GSB Mortgage, Inc and I can verify that Chris Cuellar is an employee of GSB Mortgage, Inc. which is a wholly owned subsidiary of Bank of the West based out of Grapevine, TX. Not to be confused with the much larger Bank of the West based out of San Francisco, CA.

We pride ourselves on customer service and would like to make a public apology for any misunderstanding we had with this particular client.

Chris Ceullar is a valued employee and has always received nothing but great feedback from his clients.

Hello there consumers...this post stating negative and inaccurate information against myself was brought to my attention yesterday and got permission from my branch manager to respond to it accordingly.   I am a licensed/registered loan officer and my employer is GSB Mortgage which is a wholly owned subsidiary of Bank of the West.   The person that made these obscene accusations against me do not understand the concept of branches and subsidiaries I am assuming since they went to there local bank o the west to see if I worked there which our first 7 encounters were all by email....and on my email it clearly states on there GSB Mortgage 2811 Internet Blvd. ste. 275 Frisco, TX 75034 and below that signature on my email it has a GSB Mortgage logo stating GSB Mortgage Inc. a wholly owned subsidiary of Bank of the West.  I did speak to the client and his wife which the conversation lasted less than five minutes do to the fact that the conversation was highly unpleasant once the wife got on the phone but I was trying and I state trying  to explain the information I had sent out to them which I refer to as a Home Loan Packet/ Needs List.  The clients wife got irate with me and demanded that I quote them a  APR which I tried explaining I can not give them a quote until I run all their information with the listed items require which any loan officer will request before they give a written quote of any sort. Also, I did not cold call this client but they went online through one of our affiliate websites and willingly submitted there information and I only responded to there inquiry and made initial contact by email. 

In that list that I requested it was nothing out of the ordinary that any other bank would require which I will list here which on this list it even explains everything:

FHA PURCHASE NEEDS LIST

It is my sincere pleasure to inform you that you are pre-qualified for a FHA purchase home loan from GSB Mortgage.   I look forward to working with you throughout this exciting process.  It is my goal to deliver the most timely and professional service possible.   

PLEASE NOTE:  Being pre-qualified means that based on the information you have provided over the phone, combined with a credit pull, you should qualify for the loan.  In order to make a lending decision and provide you with a pre-approval letter I must receive the following documentation: 

þ    COMPLETED UNIFORM RESIDENTIAL LOAN APPLICATION:  Ensure every section is 100% completed.  Do not leave any blanks. 

þ    INCOME:  Copy of most recent paycheck stubs for all borrowers (30 days worth). 

þ    EMPLOYMENT:  Copy of all W-2’s and tax returns for the past two years of employment (2011-2012). 

þ    ASSETS:  Copy of last 60 days of Bank Statements from all accounts including checking, savings, retirement, 401k, stocks, brokerage, etc.

þ    IDENTIFICATION:  A legible copy of your Social Security Card AND a government-issued photo ID. 

The consumer continued to demand a APR which from what it sounded like they didn't understand there was a difference between an APR and interest rate...told them I could possibly give them an idea what range the interest rate would be in but the wife continued to demand an APR which I had insufficient information to even come up with an accurate quote.   We continued to go in circles....she kept telling me to refer to her as Doctor for some reason and when I would refer to her as Mrs. Woods she would become irate so that is probably the only thing I did wrong through this whole process was refer to her as Mrs. Woods instead of Dr. Woods but from my research she is not a doctor nor did they give me accurate information when I was trying to pre-qualify them.  If you are reading this you will notice that they stated I was a conartist because they misunderstood which bank of the west I was affiliated with.  They also led you to believe in there statement that they worked for a bank but they don't work for Bank of the West this couple has a church that they run together which I will leave out there Church name that they run and other companies that they have which they did not disclose when I was trying to pre-qualify them, all the client kept saying was that he was a doctor.  As I would never want to  slander someones name not even for good reason.  Let me continue even further to say they that they even went to the GSB Mortgage website to look me up and confirm I am who I said I am....and on that website it states our affiliations and locations of our branches so there should have been no further confusion at this point. Also, the client posted what she stated my email signature appears to look like but left out some of the information...this is taken straight from the emails I corresponded with them except the logo for some reason is not displaying when I paste it into here which the logo is not appearing for some reason when I paste the signature:

I do haev a GSB email which is [email protected] but I use the [email protected] email since it is easier for clients to write down or remember when they are communicating with me.  I use only office computers and only access my emails when I am working and had permission to use this email by my branch manager.

I am truely sorry that I could not give you a quote in writing nor verbal before I evaluated your complete  information and anyone that is giving out quotes before evaluationg your financial & credit information is not doing there job correctly.  I would also assume that a con artist would ask for money upfront or somethingof that sort which I never asked for anymoney at any time...nor did I ask for an application fee which some banks do require but ours does not.   I consider this slander and defamation of character since these accusations our fraudulent and I have back and forth communication records of all correspondence and I would definitely take an apology on here stating that there was obvious confusion or please recant your statement as this does affect my livelyhood and ability to do my job to the best of its ability. I appreciate those who took the time to read this and will understand that there are people in this world that do not think about the affects their actions will have on others otherwise I would assume they would have never even wasted their time writing such a ridiculous claim.
