Took my Toyota truck to this shop on November 9, 2002 complaining of a whining noise in the manual transmission. Being a former mechanic, I was pretty sure it was just the input shaft and bearing.

They ordered a rebuild kit for the wrong transmission, and apparently had to call me to find out what kind it was. Paid $1221.25 and recieved the truck November 16, and it sounded exactly the same! I examined the old parts, which did not include the input shaft, and could find nothing wrong with any of them.

When I took it back they tried to tell me it was normal! The transmission was louder than the engine. I told them I didn't buy it. After looking at it some more, they said they found a rebuilt transmission in Waco that didn't make that noise and it would cost another $575 to put it in. I went for it like a dope.

They did this work in mid-December. This "rebuilt" transmission would not, and still doesn't stay in first! It pops out at the worst possible moments. Took it back in January and they worked on it again. It stays in first more than it used to, but it is still pops out at times, which is unacceptable. This transmission may not whine like the other, but it's definitely in much worse condition.

While replacing the driveshaft, one of the mechanics overtightend and stripped the threads off of one of the drive shaft bolts, a critical component. I noticed this because they replaced it with an inferior hardware store bolt. And John De Santo charged me $1,800 to do this to my truck!

After several months of embarassing and dangerous driving situations, I took it back again June 3, and told John that I wanted my money back. He said I had to give him an opportunity to fix it. I told him I had given him more than enough opportunities, but offered to leave it that day and that I had to have it back by 3 p.m. John didn't seem interested.

Took the truck for a demonstration drive with his mechanic, but the transmission didn't pop out of gear!After the test drive John asked what I would do with the money if I got it, and I told him I would go straight to the dealer where they have a new transmission for the same price he charged me.

John again told me that I had to give him the chance to fix it as long as it was under warranty. I told him that if I did that, he may never fix it and he would off the hook at the end of the warranty period. He shrugged his shoulders.

I told John that I had also noticed that the transfer case had been switched without my knowledge or consent. He asked how I knew that. I said because it had junk yard paint marks all over it. He asked how he would know if I hadn't put those paint marks there myself.

John was clearly agitated. He said it wasn't fair for him to refund my money after all the work they did on it. I asked where was the fairness of paying all that money to make the transmission worse. He said he couldn't and wouldn't ever refund the money. I said goodbye and left.

That day I filed a dispute with the credit card co. for the $575, and will file another one soon for the remainder.

Hey "TRANZMN": After reading your entry, I saw a possible opportunity to expand my vocabulary. Specifically, I refer to the word you used, "falcation", a word or term with which I was unfamiliar. . I input "falcation" into the Merrriam-Webster on-line dictionary. This's the closest match shown: >Suggestions for falcation:< 1. fellation . This brought the strange situation of the word closest to which you used being a derivitive of "fellatio", a subject dear to my heart. . Am I missing something here?

In speaking to both of you today, I got the feeling there is a solution~~~~~patrick yours is getting your truck fixed per the warranty with no cost for the work previously performed.~~Jack~~~I got the feeling that you really want to handle this for patrick as you said at "any" cost~~~~~This shows me that jack is concerned about the customer. ~~~Then again i understand Patricks reluctance to have the work done here because he feels that it wasn't taken care of the first time to his satisfaction.~~~~~~~~patrick as you said that there is a constant noise while the truck is in motion~~~this could be in the differental~~~~~should be checked while in the air and in gear or someone inside shifting while someone is checkng underneath~~~~~2wd/4wd~~~~~jack~~~~the problem with the tranz coming out of first maybe as simple as a spring~~~try it!~~~~~~if the noise is coming out of the tranz~~~ verify it~~~as i told patrick it could be noise coming from the differental and traveling through your driveshaft~~and everyone thinks its the transfer case.~~~since i can't see it an check it myself you both have to involve yourselves to solve the problems~~~~~take time and comunicate be patient with each other. There are no problems~~~~because they all have solutions~~~~~~just fix it!~~~~~~~~THE TRANZMN

Dear Patrick~~~~~You seem to have an issue as you say with (fraud) = falcation.As you asked to be more specific.~~~Your contract is your work order.If the have met (all) conditions per the terms of the contract it is not fraud.~~~If the work is bad~~This is (workmanship)~~~~~in california you can take the warranty work to another shop to have it corrected,then present the repair costs to the original shop for rembursement.If at that point the shop does not comply then you can sue for damages.~~~~~~~now~~~~you have another option to further your point.If the shop will give you all diagnostic procedures mandated by cottman for the diagnosis o the transmission and they have no supporting documentation to say that it was done~~~~~~then you have a strong arguement for workmanship issues.It may be good to put out all your points here on the site so i can answer your questions so you can ask them questions.Please tell me what year and engine size,Thankz ~~~~~~~THE TRANZMN

I have read your rip-off report and appreciate your position, but as you now know, the justice system is broken. I suggest using rip-off revenge!! If you haven't gotten it yet, get it. It's 20 bucks well spent. I further suggest that we may be able to get together on this and perhaps get both of our monies back. Perhaps the editors could help us on this. I am planning on gathering sufficient and irrefuttable evidence about my case before acting.

Patrick I was ripped off by Cottman's here in Cedar Park,Texas. It was over my clutch in a Ford F-150. I filed with the BBB, that was not productive,a waste of time, I filed with the Attorney General, again a waste of time. I took it to court JIM NICKELATTI lied in court. That he was not remibursed his money, which I know he was, through BOB COLEMAN (the once shop foreman) I lost in court because he said JIM NICKELAATTI said he did a friend a favor and that I was harrassing him. I talked to that man one time and he told me to go haunt someone else!!! I spent $895.38 on that clutch which chattered at take off and in reverse, it would barely go up a hill!! I had another shop replace my clutch, that was another $600.00.Before I finish the whole story,first I had my clutch replaced in Arlington, Texas. Over the phone I was told it would be $550.00 and when they towed my truck to the shop LYNN called me said it was going to cost me $895.38. The third day you could throw the gear shift to the dash because they did not tighten all the bolts, that's when I had to call the COTTMAN'S IN CEDAR PARK! I was told by BOB COLEMAN That it was just a "SILLY BOLT" that came loose!!! THEY WOULD NOT COME AND PICK ME UP AND I HAD NO WAY TO GET THERE BUT TO CALL A TAXI WHICH COST ME $18.00. BUT LYNN IN ARLINGTON,TEXAS REMIMBURSED ME.WOW!! The clutch still did not work properply but I told I was harrassing them. They supposebly put in another clutch, which never worked. So I had two clutches by COTTMAN'S, and another clutch by an entirely different shop.I was not treated right by the customer care, that just sat there and you could hear them breathing. I was told to figure it out for myself!! But after all my attempts I still did not receive my money back. The judge did not even really look at my paperwork. JIM NICKELATTI HAD TWO DOCUMENTS STATING A FIGURE ON SOME PARTS BUT IT DID NOT STATE MY TRUCK'S ID ON THOSE RECEIPTS. THERE HAS TO BE A SOLUTION TO COTTMAN'S BEING ABLE TO SELL THESE SHOPS TO INDIVIDUALS THAT HAVE NO EXPERIENCE IN THE FIELD AND THEN THEY HIRE PEOPLE THAT PROBABLY DO NOT HAVE A LISENCE. WE NEED TO BOYCOTT THEM OUT OPF BUSINESS TO WHERE THEY CANNOT RIP ANYONE ELSE OFF!!!!!

1. The most I could find on civil code 1796/1796.5 is that all work "must be done in a workmanlike and professional manner". Perhaps TRANZMN could be more specific. 2. Replacing good parts for bad parts is NOT A WARRANTY ISSUE!!!! It's an issue of JACK DESANTO COMMITTING PLAIN FRAUD!!!!
