I Don.t Know the full history of DAC service,s I only know that thay where formed to shaft the Truck Driver. Thay have the power to access all kind.s of information on any truck driver that apply,s for a Driving job. As a Driver myself I have been turned down for employment due to this report. We as driver,s have to sign a waver to allow DAC to give this report to employer,s Most Employer,s  wont even consider you for a Driving Job without it. And when you leave a Trucking co. thay send in a report on the driver.This Most Driver,s already know. The thing that thay don,t know is DAC don,t have to investigate the driver,s tale of the reason why thay left the co. in the first place. I myself have quit job,s due to divorce. with me getting custody of miner children. no family to help that lived anywhere close i didn,t have the time to give notice to my boss. then yes there was a few time,s that my boss would really tic me off by finding way,s to keep my check. or leaving me sit in a town for day,s claiming no freight. Or as now my boss pay,s by percentage and now I'm really getting the shaft. But due to pissing off past trucking co,s because of getting tired of busting my butt and getting shafted in return I can,t find any Decent co to even look at me. Ya Ive made some good scrue up,s myself but DAC has never even ask for my explanation. and why is it that if you do follow their rebuttal you only hurt yourself if you tell the truth. MY MAIN QUESTIN  IS WHY IS OUR GOVERNMENT ALLOWING A CO. LIKE DAC=USIS TO EVAN EXSIST Driver,s are on WELFAIR   DUE TO THIS KIND OF SERVICE now ya some do deserve this by taring up equipment and  late on delivery,s But a lot of Good driver,s are loosing everything thay have due to a few mistake,s All big co. have a high turnover in driver,s because of bad treatment of driver,s DAC was formed for REVENGE and is still ALOWED to practice 10 year,s is a long time to pay for a mistake. WE as driver,s may not ever shut down DAC OR WHAT EVER THAY ARE GOING BY TODAY BUT I FOR ONE WISH THAY HAD NEVER BEEN ALLOWED TO EVEN START THIS BUSSNES ......

FCRA 623. Responsibilities of furnishers of information to consumer reporting agencies
[15 U.S.C. 1681s-2]
(a) Duty of Furnishers of Information to Provide Accurate Information
(1) Prohibition
(A) Reporting information with actual knowledge of errors.

A person shall not
furnish any information relating to a consumer to any consumer reporting
agency if the person knows or has reasonable cause to believe that the
information is inaccurate.

FCMSA regulations effective April 29, 2004 make it easier for a truck driver to obtain and dispute the information in his DAC report. Trucking companies have until October 29, 2004 to fully comply with the new regulations.

Prospective employers must make an inquiry with each applicants employer for whom a commercial motor vehicle was driven within the previous 3 years from the date of application. This information must now be provided to the truck driver within five days of receipt of a written request. If you think that you have been denied employment because of a report from a previous employer, you can now obtain the information by simply sending a request to the trucking company.

Previously the only way to obtain the information in a timely fashion was to pay for your DAC report. If you include the request with your application, the information will automatically be forwarded to you. It is possible that some HR departments may not look favorably upon your request so you may want to wait until you are actually denied employment.

Prospective employers will be required to notify truck driver applicants of their right to review the information obtained from previous employers, to correct errors in that information and to file a rebuttal of any incorrect information.

If there is incorrect information on your DAC report then you need to contact your previous trucking company and request a revision of your employment history. The request needs to be specific and you need to provide any supporting documentation. It is always a good idea to keep a copy of your logs for your own records, especially if the trucking company should close and you need to verify your experience. Send the request by Certified Mail, Return Receipt.

Your previous employer has 15 days to respond to a driver's request for a correction of erroneous safety or work history information. If the truck driver chooses to submit a rebuttal, the previous employer has 5 days to forward the information to the prospective employer and to append a copy of the rebuttal to the drivers permanent safety performance history.
