Like many other people, I ordered a free sample of a whitening-teeth product. To get this free product supposedly I only had to pay shipping and handling. A form asks the potential customer in how many days he/she wants to have their teeth whitened, from 1-2 days up to a month. I wondered why they were asking this ridiculous question if I was only trying the product, but I believed I said 1-2 days just to put something. The order form in the Internet asked me for all the normal information, name, address, shipping address and so on. Then I verified that I was purchasing this product for about four dollars or so in shipping andhandling and I clicked saying "Yes" and provided my credit card.

The next month my credit card was charged $ 92.37. When I contacted the company to find out what was the problem, they said that by ordering the product I had become member of a select elite group of people with the privilege of receiving the product every 3 month in my case apparently at the montly fee of $ 92.37. When I complained that I did not agree to this "offer" and would never agree to this the employee named Cjhristian asked me to go back to the page where I put the order and then I realized a very small box with minuscule pink colored letters that can barely be read which starts with "Offer Details" which says that once you provide your credit card you will be charged this monthly fee for life until you decide to call them and cancel "the deal". I asked Christian for an immediate cancellation and asked for a refund of the amount already charged to may credit card. He said he could not give me a refund. I asked to talk to his or her supervisor. He left me waiting in line for 15 minutes and then hang up on me.

Since then I have known that this company operates in several states. They operate in Utah as "dazzlesmile, lic" with an address of 891 West Robinson Drive, Building 1, North Lake Xity, UT 84054.

They also operate in Owa under the name Dazzlesmile, PO Box 10276, Des Moines, Iowa 50381.

And they probably operate at least in Delaware, because my credit card charge listed the phone number 877-289-5304 followed by "DE" which I believe is a Delaware number.

This is obviously a case of fraud against the consumer. It is also unfair and misleading advertising because the terms of the sale are not disclosed to the customer in the window that he/she has to "see" while placing the order. Putting the information in a little corner is not proper disclosure, in fact it is misleading and grossly unfair.

I have requested a refund of the amounts illegally charged to my credit card, but I am more concerned about stopping those practices than about the refund. The company is doing something illegal and should be stopped. This is why I have filed complaints with the Attorney Generals of all the states where I believe this company is doing business, have filed a complaint with the Better Business Bureau and with the Federal Communications Commission and will continue to file complaints anywhere they will listen.
