First, let your insurance company handle the dispute. That is what they get paid for. They will fix your car and go after DAS for the damages. Secondly, if you have to pay a deductable out of your pocket, write a certified letter, return receipt, to DAS letting them know that if they don't refund your deductable within 14 days, you will turn the matter over to the Attorney General's office, and take them to court. If they don't pay, file a complaint with the AGs office. You can do this online. Don't be fooled by their claim that they can't pay you because you didn't take out the insurance. The fact is, they ARE insured no matter what. It's the law, but they do not want to turn in customer claims because they don't want their premiums increased. Don't let them off the hook. I ship cars all over the US, and have had my share of damages. I have never had pay a cent out of pocket.
