My daughter's father is a disabled veteran of the United States Army. He refuses to help support our child. I have already have a court order that he is suppose to pay child support. However, per the government they can not garnish his wages due to hardship it might cause on the veteran. So I contacted the Dept. of Veterans Affairs to seek support since that is where he gets his check. I started getting apportionment payments for a good 2 years without problems. However, last year or so I got a notice stating they would stop payment because the veteran has failed to update his dependent record and all the monies they paid of the 2 year time period I now have to payback. I tried again and again to have him (the father/veteran) update the information and he lied and said he did which I called to verify and he didn't. Finally, I got him to sign the forms and I mailed it in and which they received and now the case is pending. However, in the meantime, they sent the information to a collection agency while I was making him sign the papers and now I am getting harassing phone calls at my work and somehow the collection agency got my cell phone number. The Collection agency has stated she gave me two days to come up with the money and now she will take action to garnish my wages through my employer. I don't think they can do that unless we go to court and I defend my case, right?

The father refused to pay child support, so you go after him through the V.A.and now they stopped payment, and want you to pay back 2 years worth, and they have sent this to collections? If I were you, I would send a letter to the Attorney General's office and hire myself a lawyer, because that is not right at all. There are laws that protect you, and if he isnt paying child support, then he should be going to jail. I would hope this goes to court, so you can address the judge on this issue.
