From: Christine Sent: Saturday, June 26, 2004 9:30 AM To: Don Davis Nissan Subject: FOR THE OWNER - KEEP AWAY FROM JEFF ROBERTSON AND GEORGE MURRY

I wrote this e-mail yesterday but as you can see, I'm not allowed to send y'all e-mail either. I drove around the dealership for a couple of hours last night and was quite pleased that many folks test driving cars saw my message. I'm going to head out that way in a few minutes and drive around some more. However, I have to be at Trophy Nissan at 10:30 as they have the car I need in stock and said that they would trade me out.

You still haven't heard the last from me yet.

Christine

Dear Sir or Madam,

My name is Christine. I recently purchased my 5th consecutive Nissan Sentra and my 6th consecutive Nissan product. I am not happy. George Murry in used cars handled the sale and assured me that whatever the car did not have could be added. Well, he found out he was wrong a week and a half later when it was discovered that cruise control could not be added. They seem to think this is my problem and are willing to put me in another Nissan as long as I do not mind taking nearly an $8K loss on my brand new car. He tried to tell me that he was giving me a great deal on a used 2004 Altima by selling it to me for $17K, $3K less than the MSRP to help compensate for the loss. Well, a brand new Altima is $19K at most of the other dealerships around here, I checked.

During the course of the meeting Wednesday night, Jeff Robertson left to see what could be done as I was upside down $1300 on my trade in and I told him I had that so that was not a problem as I have the money. That left myself, my sister, her daughter, her daughter's friend and a toddler in the room with George. George became irate and tried to twist my words. I tried to keep calm but when you have a man yelling and pointing a finger in your face, it's rather hard to keep calm. I told him he needed to leave the room, as I was tired of his bullshit. He grabbed my car keys and told me that I was going to pay for that and he was going to call NMAC in the morning and turn my car in as a repo. I came out of that room after him and told him to give me my keys or I was calling the police - my house keys were on that ring too. That is when Jeff Robertson told me that he would not deal with me and that I had to leave. Then George tried to suck up to me and sell me that Altima. He even let me take it home for the night but I knew I wasn't going to buy it because I will not spend $400/mo on a car payment in addition to the $400/yr increase for auto insurance. The fact that the car is too big did not help either. I love the Sentra; it's just my size. Well, you all have not seen nor heard the last of me. I will be driving around the dealership tonight & tomorrow proudly displaying my back window that states "DON DAVIS NISSAN TELLS LIES". I have contacted NMAC and Consumer Affairs and told them of the behavior of these two "men".

To you, cruise control may not seem like a big deal but I am handicapped and I need cruise control to assist in driving. I do not appear handicapped to the normal eye but years ago I cracked my kneecap in ? and arthritis has settled in as well. I can walk fine but when driving, my leg starts shaking and I can't hold a steady speed. They treat me as if am a stupid woman and don't know how to crunch numbers in an auto deal but I do. I am a degreed Accountant with 24 years experience and my brother was Senior Loan Officer at DTCU for 12 years until he became Vice President of Members Choice Credit Union. I am also going to call my step brother, Lewis (Bud) Willis III, who works in the Farmington Hills location. I do not know how many of the TV stations are going to show up tomorrow but I have sent them all an e-mail telling them I will be doing this and how Don Davis Auto Group discriminates against handicapped women and thinks that deceptive trade is not illegal. BTW, I am also a former employee of KIII-TV3 in Corpus Christi, TX and they are following this story closely as well. George accused me of making idle threats and I assured him that I am not threatening, it is a promise. I have also contacted my attorney and he wants to wait and see if y'all will straighten this out before we file suit.

Do you want to work with me or not?

Christine

Rick Coleman did call me that very day and worked with me putting me in another Sentra that had cruise control. However, fate had a different hand dealt to me and things didn't quite work out. I sent them a fax on July 01, 2005 but did not receive a response. I called Rick Coleman on October 12th and he claimed to never have rec'd the fax. He made it sound as if he would help me again and I had no reason to think he wouldn't after what he did the first time around. He also claimed that the fax number I used went to a pool and anyone could have the fax. Not true, the fax number I have goes straight to the President. Another lie !

Mr. Coleman,

I realize that you did not request a copy of the fax that I sent on July 01, 2005 but I thought I would forward it to you just the same.

Hello,

Do you remember me? Well, if you thought I was mad last year, I am madder than ever this year. I have contacted 1-800-NISSAN1 and lodged another complaint against your firm. When I bought my first 2004, I purchased various maintenance agreements, service agreements, Disability, Life and Gap. When Cole was selling me the Disability Policy, for which I am sure y'all get commission, he assured me that a pinched nerve did not constitute a previous injury and therefore checked the box no. He said that they were looking for more serious type injuries as folks can get a pinched nerve and recover no problem. When we tried to resolve the issue of the first car not being able to have cruise control added, I did not renew all of them. In July, I came down to cancel the extended warranty as my brother told me I could get it cheaper through another firm. Mr. Rivera was kind enough to handle the paperwork for me. A month later I received a refund check and called Mr. Rivera and he said that he had canceled everything right down to the GAP coverage. He continued to say that since some of the policies were under a certain dollar amount that they would not be refunded to NMAC but sent to me and that is why I received the check. I was so dumbfounded that I didn't know what to say but I have a copy of the document and all of those numbers are there and I signed it. I pulled out my papers and compared the policy numbers and they didn't quite match up but I figured your A/P dept was as competent as the rest of your staff. Now, fast forward to October. I lost my job and was taken off work by my doctor as I lost almost total use of my right arm. I had been doing landscaping in my yard and figured whatever it was could be fixed quickly and things would be fine. I called NMAC and had a couple of payments waived to help me out. An MRI in December revealed that I have Degenerative Disk Disease, Stenosis, Osteoarthritis, Cervical Radiculopothy, Cervical Compression, Multiple Herniations and Bone Spurs. I am going to be out of work for more than a year. Now I am thoroughly depressed as Mr. Rivera was kind enough to cancel my Disability for me, I am being sarcastic. Now we are in March and NMAC is calling wanting my car. The man I spoke with, Hammed (sp?) told me that my disability had not been canceled and that in fact, nothing had been canceled. I told him about the refund check and he assured me that the monies would not have been sent to me regardless of the dollar amount. He said that since the check came from Don Davis that I need to call y'all and find out why I was sent a refund. I spoke with a lady in your A/P dept and she told me that the refund check was for the first 2004, as I was not given enough credit on my trade in for the second 2004. She also said that since that document was done in July and Mr. Rivera had not filed it that it must be lost and to count my blessings. Ok, now I am excited as that means I do have disability coverage and I get to keep my car. I filed my claim and got denied. Do you know why I got denied? A pinched nerve is considered an injury and I therefore lied on my application and they canceled my policy sending a refund check to NMAC. My car is now on the Repo list. I am also in the process of filing bankruptcy and was hoping to get to keep my car a little bit longer. My attorney said that I need to turn in the car because even after all is said and done I will not be able to afford the payments with my Social Security Disability. We were also looking into the aspect of filing an appeal with the insurance company but after going through the documents, I do not have a case and they are in the right. He said I need to sue Don Davis as I had a witness with me who can testify as to what Cole told me but he doesn't handle that type of lawsuit. Not to mention the scenario with Jeff Robertson and George Murry. I have also been in touch with the reporters that phoned me last summer and am seeing about getting this whole story back on air and let everyone know what your dealership has done to me.

The one thing that really bothers me is how many other people has your firm done this to? What if I never had a need to file a claim? I would never have known that I spent appx $1K on an insurance policy that I could not even use because your staff lied to me. I am correct in assuming that y'all get commission? Sounds like a scam to me. After all, what are the odds that a person will need to file a claim?

The lady at Allstate told me an injury is an injury regardless of its severity and had I been honest they may have waived it as a pinched nerve is not a serious injury.

By the way, I traded in a 2001 Nissan Sentra GXE that would have been paid in full this coming October. I should have followed my gut feeling and not have bought a new car at all. My total investment is lost and I will never do business with your firm again as I have lost total faith in your staff. I'm not even sure if I will ever buy a Nissan again as NMAC will never finance a car to me because of this mess. I bet y'all are going to be really busy this weekend what with it being a holiday and all. I still have my shoe polish.

Thanks for nothing, Christine

Of course, nothing has been done as I've never heard from Rick Coleman again and he didn't return my calls. As for the news media that was supposed to follow up on the story, well, other things came up and I got put on the back burner. They now feel the story is old news and don't want to bother with it. Since it's been a little over a year since my car was repo'd, I'm sure nothing can be done other than letting everyone in the world know what they have done to me and could do to you ! I did lodge a complaint with Nissan USA and if enough people complain about them, they can lose their franchise ? sounds fair to me ! So if Don Davis has ripped you off, call 1-800-NISSANUSA and post it to this website. I am so disgusted by the whole situation that I do not intend to ever buy a Nissan product again. However, that July weekend, I did drive around the dealership with a new message polished on my back window "Don Davis Nissan lied twice, is 3 a charm!"
