In March of 2006, I purchased Earthlink's promotion package for dsl (after having dial-up with them for over 3 years). There was an early termination fee of $149. Due to unforeseen circumstances I had to move in October. My new location did not provide ANY dsl services due to old lines in the area so I had to go with cable or nothing at all.

Upon finding this out,I called Earthlink in October and explained my situation. Being a good customer for over 3 years, with my payments being taken out automatically and on time every month, I asked them if they could help me out with this early termination fee. They agreed to waive the fee and they stopped the automatic withdraws from my checking account. I THOUGHT everything was fine.

Three months pass and without any notice from Earthlink at all, I received a Collection letter in the mail in January for the $149 fee. I immediately called Earthlink and asked why they sent me to collections. I was informed it was an error and they would remove me immediately and gave me a confirmation number. Obviously this was never done as the collection calls start pouring in.

My 3rd call to Earthlink. The rep informed me that this SHOULD of been taken care of and she didn't know why it wasn't. I was then given yet another confirmation number and of course, promised she would take care of it. WRONG AGAIN! Things were quite for about 2 weeks and then the collection calls started all over again. Looks like earthlink are nothing but LIARS! The collection rep advises me to do a 3 way conference call to clear this up but Earthlink refuses to do this.

OK, here we go with call #4. This time I am insistant on speaking with a supervisor (whom the rep was very reluctant to put on). After an hour wait, a supervisor finally gets on. He apologizes for the "mix up" and assured me an email and letter were sent to collections 2 days ago instructing them to remove me from the list. He ask that I wait 36 hours for it to clear collections. And yes, another confirmation #.

It is now almost a month since my conversation with the supervisor at Earthlink. No harassing phone calls or letters since then....UNTIL TODAY... when I got my mail. Earthlink has now turned my "deliquent" account over to a law firm for collections!! I appreciated them stating they would waive the fee but why tell me that and then turn me over to collections and then a lawyer!!! They have never acted on anything they promised to do!! LIARS! LIARS! LIARS!

How do you collect a ZERO balance? Earthlink FINALLY sent letter to collections stating I have a zero balance due but will not give the authorization to remove my name from the collection list. So my credit is still at stake even with a zero balance. I am still in collections for the full amount ($149) with the law firm they also sent me too. Which I just recently found out happens to be Earthlink's attorneys. So Earthlink informs the collection agency that I don't owe anything and their attorneys to go ahead and pursue the $149. Talk about speaking out of both sides of your mouth! Obviously they have no clue what they are doing or its a case of extreme miscommunications between departments. I have NEVER dealt with such incompetency in all my life! If you don't want these headaches, please do yourself a favor and choose another ISP. I contacted "Call for action" on a local news station regarding this mess and after she called Earthlink and spoke with 4 representatives who were "clueless" she advised me to get in touch with the Attorney General's Office of Consumer Affairs as she feels I will get some satisfaction there.
