On March 13, 2010 my car was driven through flood waters in New Jersey during a Noreaster. The flood had caused water to get into my engine causing my engine to seize. I had filed a claim with Esurance (my auto insurance company). I had then proceeded to file a police report of the incident with the town that the incident occurred as well as file a claim with Esurance. At first Esurance wanted to replace my engine with a used engine. I had contested that course of action since this did not address water damage in the electrical components and wiring which could have lead to control unit in the future. Esurance informed me that by law they are only required to replace an engine with comparable mileage. I contested the approach as the warranty for this used engine would have only been for 90 days. I felt unsafe having a used engine in my car. Primarily since there was obviously issues with the car that this engine came from if it wasn't in that car to begin with. Secondly, a 90 day warranty would not have protected me from potential issues that could arise from this engine after the 90 day period. Esurance had decided that the cost of a new engine would cost more than the value of the vehicle so they decided to total the vehicle. For 2 months I waited for Esurance to finalize the claim. I just had found out today that Esurance is denying my claim and are not going to resolve the engine. According to Esurance, they are telling me that I did not drive through water (basically calling me a liar) since "forensics" were performed on the vehicle via some investigator hired by Esurance. Aside from being insulted by Esurance and being called a liar I had the vehicle assessed by 2 auto mechanic professionals. They both had suggested to me that the vehicle damage was beyond repair and this vehicle needed to be totaled. Basically I have been paying Esurance for auto insurance and they have basically told me to screw myself and we aren't paying for the damages. This is unfair business practice and I do not appreciate Esurance for RIPPING ME OFF.

Just ignore Anonymous probally a insurance company employee.  Insuance companies LOVE It when someone has to struggle,  because they don't want to pay because of there insured causing the accident.

In fact insurance people get off seeing people struggle,  losing there homes cars everything they worked for.  Because they don't want to pay!.  They should be thrown In JAIL.  Because they are "CRIMINALS"  themselves.

They laugh @ people having to struggle.  Because there insured caused them all these problems.

Just don't reply or say anything to stacy.  She has no "GOOD POINTS" to help anyone.  All she does Is provoke people,  she really wonts to get to me.  People don't want me to receive justice.

I can't trust anyone anymore,  all they want to do Is hurt me or try to ruin my life.  When I don't allow people to treat me like "TRASH",  Is when the trouble begins.

Yes I do have the right to post on any report I please.  Who the hell you think you ARE! tell me or anyone they don't have the right to post comments.  I HAVE NEVER DONE ANYTHING TO YOU.  So why do you even comment to me. 

You need to mind your own business.  Its called ONLINE BULLYING,  I don't have to take anyones crap.  YOU got that stacy.  So you need to shut your big mouth.  People have to put up with YOU along with all there other problems they have.

That of course is unreasonable. But there are used engines that have more then a 90 day warranty..A 90 day warranty is not enough to be worth all the labor costs and then if something goes in 3 months and a week, the customer is out of luck. And the customer is correct to be concerned about the electronics as they do not like water..and if water got in the engine air intake..it most likely got to almost all the electronics in the vehicle. And any interior upholstery that got water in it as well. would most likely need replacing once the mold comes. To fix this right..the entire interior needs to be gutted..the floor pans need to be scraped..it's a big job.

The vehicle if flood damaged, should in most cases be totaled. Can I blame the insurance companies for trying to get off cheap? Of course not..but it is still up to the insured in the long run. If you allow these insurance companies to trample all over you..they will almost every time. My Father rest his sole was an insurance investigator, an insurance adjuster, and had his own brokerage. So I have seen first hand what they try to get away with.

Now perhaps Texas has a lot of flooding..wouldn't surprise me. It also wouldn't surprise me that there are plenty of "sub par"  fools there. But NJ does not have a "flood season" and is not an area that is as commonly effected historically to have this kind of flooding by nor' easters. I figured Stacey would know this..she is supposed to be the expert on everything. Well I am actually..but she often has good points..she just seems to get some kind of jolly out of provoking others..like our friend Robert from Irvine.

However, I am not going to get into useless debates about weather conditions, go debate the farmers almanac...but what I can say is a fact..that unless there is some kind of stupidity clause in the insurance policy...or a clause that states driving through a flood will not be covered...then the insurance company needs to do the right thing, or THEY are the ones conducting a scam, which without further information or proof of this "forensics"..I see no other way to view this.

Texas is often a place for flooding especially in Spring - people continue to drive into flooded areas regardless of the signs, warnings and road blocks - they waste taxpayers monies because they get stuck then cry foul

You drive into a flood area then demand a new engine you are a fool - YOU did not have a new engine in the vehicle when you drove into the water therefore you do not get a new engine because of your stupidity

It is very easy to come here and knock others "anonymously", but it seems some are accusing this person of fraud. While I agree no one with any sense should drive into a flood, we do not know all the circumstances. What we know based off the report is..

There was  nor' easter storm

The car was driven through flood waters (but we do not know if this was done with intent to damage the engine and collect insurance)

The flood waters caused the engine to sieze ( this is called "hydrolock" and it occur when water enters the combustion chamber through the air intake. It happens if you drive through flood waters. The water can not compress like and air fuel  mixture..so it causes serious internal engine damage, and IS covered under insurance if you have comprehensive coverage)

Now whether or not this was done with intent, or it was by chance due to a flash flood or emergency is one thing. But if it was stupidity..unfortuantly that is covered. Unless the policy specifically states "you lose any coverage of flood damage due to stupidity", they must pay up..plain and simple.

 The insurance company wanted to install a used motor with a 90 day warranty..I can understand the reluctance to do this.

Typically, a vehicle is considered "totaled" if flood damaged because of the expense of a good engine, and other electrical issues, mold to the interior etc..it's usually not worth fixing and the vehicle is totaled, salvaged titled, and sent off to auction or sold for parts.

Since the customer did not want the unsafe "cheap" way out, the insurance company decided instead of totaling the vehicle..to simply deny the claim, and say some kind of "forensics" have proved the vehicle was not damaged due to water.

So..lets reason this out. Either there was no water damage at all and the insurance company is correct that this is all a fraud, but was willing to install a used motor with a shitty warranty anyhow...or...

 there is water damage that was assessed by two mechanics, and the insurance company simply does not want to properly total out a flooded vehicle, so they deny the claim.

Which one makes more sense? duh?

As far as our rates...take a minute of your time and do an internet search..see how much the insurance companies make a year. And see how many complaints there are of them denying claims that are most likely legit.

Now am I happy my auto insurance is so high...and when I ask why the company tells me "because of fraud". So I ask them....well I have been driving for years and years without a claim or fraud..so why are you raising my rates? Raise the rates of the fraudsters if there are so many. Trust me..the insurance companies are not struggling..but many of us have to if we wish to collect on a claim they are supposed to cover, but deny.

If they would give everyone a brand new engine that ruined theirs then everyone would drive through water, like you did! Apparently you never been through a nor' easter, or a flash flood...

But regardless, if the insured was covered for water damage, and water damaged the engine during a flood, they need to pay up.

Is is wise for someone to drive in a flood? Probably not. But how do you know the circumstances to judge the poster as a scam? Have any evidence? Maybe there wasn't a flood when the poster was driving and then the waters rose. It happens, you can watch videos of it if you care to. So what does someone do if they are driving home or wherever and the water rises? Or what if you are driving in a storm and can't tell how deep it is..do you get out an measure the depth? Sometimes cars get caught in flood, while park..or while driving...ever watch the news or open a newspaper? And THIS is one of the reasons, people pay out the a*s for auto insurance. NJ is probably the highest in the nation..maybe the world.

This Poster has plenty of evidence. Two professional mechanics assessed the damage, and according to historical documentation, there was certainly a nor easter and flooding that occurred in the area at the time the poster claims it happened.

So, going by the evidence and posters report, it is safe to assume the only SCAM being conducted here, is by the insurance company..and it certainly would not be the first time..just do an internet search if you don't believe me. Or maybe the insurance companies "forensics" needs a little investigation?

I am confused, you drove into the flood?  The car wasn't parked and the flood drown it?  You confused your car for a boat and drove into the flood?

Heck if they end up covering your claim on this obvious insurance scam, let me know so I can claim stupid, drive into a flood and get money or a brand new engine.

Just do an internet search for something like "nor'easter flash floods New Jersey March 13, 2010" and present that as well. Not only is there plenty of articles and news reports, but quite a few videos as well..solid evidence.

Those that do not know what a "flash flood" is, it is defined as such..."A sudden flood of great volume, usually caused by a heavy rain."


This is common with a nor easter, this particular one was really bad, and flooding can and does often occur well before roads are officially closed. NJ is a big state..I know I used to work in the area where this happened, same county.

Insurance companies have already been introuble for denying claims.  People should be able to sue them,  for failing to fix there car.   People these days have to drive In damanged cars,  because there insurance company or the other side refuses to fix It.

The insurance commisioner office lets them,  get away.  With not treating people fairly,  cheating them out of a fair settlement.  There car gets repoe,  credit ruin.  People end up homeless because insurance companies refuse to pay.

We pay insurance to be responsible and be covered, and it seems some insurance companies do whatever they can to get out of paying claims.

What happened with me was my car was stolen and recovered 2 days later laying in a puddle of mud in Miami with the rims missing and a bunch of odds and ends missing, some minor body damage.

The engine was good and the car just needed a few thousand in parts to get it back to normal. It had less the 9000 miles on it. The car sat at the back of my shop for a year, they decided not to pay and accused me of fraud. I was able to collect from them eventually ($7,500) because a customer of mine was a lawyer, and took the case free of charge.

So, you may need a lawyer (or let the insurance company know you are considering one) to collect what is due to you from these heartless cretins. Having flood damage occur while driving in the north east during a nor'easter is reasonable to believe.

Having the mechanics who originally assessed the damage sign affidavits is a good start. Do not give the impression you are going to give up..they will pay if they see you are serious about collecting on this claim. I have family in the insurance business and was told it is common practice to deny claims since a percentage will not fight hard enough and give up, and it saves them money. Don't be a victim.
