I unfortunately have to say that I am a victim of Fairbanks Capital also.

I have been trying to work with Fairbanks on our loan for several months now, well it came down to us being three months behind on our house payment. In those three months, we were trying to get them to send a letter to us or our employer to get a loan off of our 401k, and just like everyone else they made promises and never came through.

I have also done everything I could to get the information to my husband company, so we could get this taken care of. Well on February 24, 2003 I finally talked to a gentlemen by the name of Stan (from Fairbanks) that promised me that he would get everything that I needed to my husbands 401k people within 2 working days. Hey, and guess what, he NEVER did. He even knew exactly what I needed and who he needed to fax it too. Wow, this guy is really going to get this done. He even told me that he would let his supervisor know of all the problems I have had. Trust me, by this time of course I did not believe him, I would hold out till I talked to the person at my husbands work. Well I'm sure glad I didn't hold my breath.

I do take complete responsibility in not being up on my monthly payment. My husband and I have had a really crappy two years. I gave birth to our last child at the end of the 2001. We have four children and I had gotten laid off from my job a year and a half before our last child, so yes things have been very finacially touch. Everytime I think we are going to be fine, something else happens. And of course as a mother and wife I blame myself for not having a job.

So to top all this off, I called this Stan guy this morning (like he told me I could) to see why he had not faxed the letter to my husband work and I got some lady on the phone and of course she told me I couldn't just call in and ask for a certain person, because thats not how it works. I concluded in saying that Stan had told my that I could ask for him, and of course she continued in saying that not how it works.

So you could probably guess that I started raising my voice and asking why would Stan tell me this and lead me to beleave that all I had to do was talk to him and he would "take care of things for me" (his words the first time).

Well I ended up hanging up on the lady. I was just P---ed! I have had the run around to long!!! Well I calmed down and called back a few hours later and talked to another guy and told him the whole story about Stan and what can I do to get this taken care of, he now tells me that we owe 3,100.00, because it went into foreclosing today; I said imagine that! I am sure it is because of my phone conversation with the women from this moring. And quess what, I had to call customer service to get this information sent to my husbands 401k people, so I did, she sent me to another phone number and quess what,

I got disconnected after being on hold for about 6 min.

I just don't understand how company's can get away with so much crap? This just should not happen in America. You know, just like a lot of other people, I've been through alot of --it in my life and in someway I have always found a way to deal with it, but I just can't believe this so called company. And what is even worse, I can't believe that there are people that work for this company and do the things they do. I KNOW I would NEVER work for a company like this. Broken promise after broken promise. I would hope that people would have some kind of a conscience when they lay their head down at night.

What can I do, is my question to any attorney general, attorney, judge, president, whoever cares!! How do look my kids in their eyes and tell them we have to leave our home.

And another thing I can't believe, is how many people have written in about Fairbanks. I about flipped.

Still a rip-off, but stopped my foreclosure

What I had to do to stop foreclosure!!! My husband and I went to see an attorney about our situation. Basically she told us that Fairbanks did not legally have to send us the information that we needed to do the hardship off of our 401k. We could hire her and they would probably send her one knowing that we now had an attorney involved. So my husband and I decided that maybe we could try one more time on our own. Well my husband called and they put him in touch with a guy named Greg and he informed my husband Mark that he, Greg was the bottom of the line, that we needed a total of $3,304.45 to keep our house from going into foreclosure. Mark told him that we needed a statement stating exactly what each charge was for and the date is was needed by. Surprise! They finally did what they said they were going to do and our 401k people received a few days later. And we had it paid in full by the next week, before the due date. But needless to say it cost us double of what it would have if they just would have sent it when we asked for it the very first time. And we will take a big penalty for taking it out of our 401k, early withdrawal and plus taxes. So basically we paid big for this. I am now going to try and refinance with a local bank. I will let you know how we are doing with Fairbanks... We all need to keep up with this company, because something needs to be done with this awful company. Good luck to everyone.
