I recently applied to have my home refinanced with another lender. Fairbanks falsely reported that my home was in foreclosure and payments were late.

My payments have never been late and I was never in foreclosure. After numerous calls and being put on hold for hours, I finally gave up.

Fairbanks Capital should be treated just like their friend EquiCredit and put out of business

We started out with Equicredit too. I was flat out lied to by the first Fairbanks customer service rep I ever spoke to. He told me that Equicredit was gone, the employees all out of jobs. It was a LIE! Every week in my local newspaper there are notices of foreclosure. One of the companies foreclosing on the homes is none other then EQUICREDIT! Who ever told you they are out of business lied to you too, just like they did me.

Hi-- They are in violation of the "Fair Credit Reporting Act" and you need to file a complaint with their banking regulators. Do an internet search under "Fair Credit Reporting Act" "Predatory Lending" and "Truth in Lending". Write one letter with all the facts and send it to as many agencies as you can find. HUD, Attorney General, banking regulators in your state, the national banking regulators, etc. Not all agencies will have jurisdiction, but they will normally forward to the agency that does. Sending multiple copies right off the bat saves you some time and increases your chances that your complaint will land on the right desk. It might take a while, but you are most likely for punitive damages as well as actual damages. The tactic you describe is very common with predatory lenders. They don't want their customers refinancing because they lose money. Good luck with you case. As you can see from this website, you are not alone!

Filing false information on consumers credit reports is illegal, (fines up to $15,000.00 per incedent). You need to dispute this with the credit bureaus directly, they will investigate the information and ask Fairbanks to prove their case within 30 days. The first thing you need is a copy of your credit report. You should be able to get a copy free by calling one of the agencies listed below, or you can visit www.myfico.com to order a copy. Once you have your report, you can file your dispute online, by phone, or by mail. Make sure you contact all 3 agencies. Many other Fairbanks victims have done this successfully.
